धारा 361 — जिन मामलों का मजिस्ट्रेट व्ययन नहीं कर सकता उनमें प्रक्रिया

361. (1) यदि किसी अपराध की जांच या विचारण के दौरान, निर्णय पर हस्ताक्षर करने के पूर्व कार्यवाहियों के किसी प्रक्रम पर, मजिस्ट्रेट को यह प्रतीत होता है कि मामला ऐसा है जिसका विचारण किसी अन्य मजिस्ट्रेट द्वारा किया जाना चाहिए, या यह कि मामले का विचारण मुख्य न्यायिक मजिस्ट्रेट द्वारा किया जाना चाहिए, तो वह कार्यवाहियां रोक देगा और मामले को, उसकी प्रकृति स्पष्ट करने वाली संक्षिप्त रिपोर्ट के साथ, उस समुचित प्राधिकारी को प्रस्तुत करेगा जिसे वह निर्दिष्ट किया जा सकता है।

(2) वह मजिस्ट्रेट, जिसे मामला प्रस्तुत किया जाता है, यदि ऐसे मामले का विचारण करने के लिए सशक्त है, तो स्वयं मामले का विचारण कर सकता है, या उसे अपने अधीनस्थ किसी मजिस्ट्रेट को निर्दिष्ट कर सकता है, या अभियुक्त को विचारण के लिए सुपुर्द कर सकता है।

Section 361 — Procedure in cases which Magistrate cannot dispose of (English)

361. (1) If, in the course of any inquiry into, or trial of, an offence, it appears to the Magistrate, at any stage of the proceedings before signing judgment, that the case is one which should be tried by some other Magistrate, or that the case ought to be tried by the Chief Judicial Magistrate, he shall stay the proceedings and submit the case, with a brief report explaining its nature, to the appropriate authority to whom it may be referred.

(2) The Magistrate to whom the case is submitted may, if empowered to try such case, either try the case himself, or refer it to a Magistrate subordinate to him, or commit the accused for trial.
