धारा 359 — अपराधों का शमन

359. (1) इस धारा के अधीन दी गई सारणी में विनिर्दिष्ट अपराध, उस सारणी में उल्लिखित व्यक्तियों द्वारा समझौता किए जा सकते हैं।

(2) कुछ अन्य अपराध, उस न्यायालय की इजाजत से, जिसके समक्ष ऐसे अपराध के लिए अभियोजन लंबित है, समझौता किए जा सकते हैं।

(3) समझौता योग्य अपराध के दुष्प्रेरण या उसे करने के प्रयत्न पर भी समझौते का अधिकार उसी प्रकार विस्तारित होता है।

(4) जहां किसी अपराध का समझौता करने के लिए प्राधिकृत व्यक्ति अवयस्क है, या विकृतचित्त है, या मर गया है, वहां उसका संरक्षक या विधिक प्रतिनिधि, न्यायालय की इजाजत से, ऐसे अपराध का समझौता कर सकता है।

(5) अभियुक्त के विचारण के लिए सुपुर्द किए जाने के पश्चात्, या जहां मामला अपील में लंबित है, न्यायालय की इजाजत के बिना किसी अपराध का समझौता नहीं किया जाएगा।

(6) [उपधारा (6) सारणी के प्ररूप और तत्संबंधी विशिष्टियों से संबंधित है।]

(7) जहां अभियुक्त की कोई पूर्व दोषसिद्धि है जो अधिरोपणीय दंडादेश को प्रभावित करती है, वहां कोई समझौता अनुज्ञात नहीं किया जाएगा।

(8) इस धारा के अधीन किसी अपराध के समझौते का वही प्रभाव होगा जो उस अभियुक्त की, जिसके साथ अपराध का समझौता किया गया है, दोषमुक्ति का है।

(9) इस धारा में उपबंधित रीति के सिवाय किसी अपराध का समझौता नहीं किया जाएगा।

Section 359 — Compounding of offences (English)

359. (1) The offences specified in the Table given under this section may be compounded by the persons mentioned in that Table.

(2) Certain other offences may be compounded with the permission of the Court before which any prosecution for such offence is pending.

(3) The composition right extends similarly to abetment of, or attempt to commit, a compoundable offence.

(4) Where the person authorised to compound an offence is a minor, or is of unsound mind, or is dead, his guardian or legal representative may, with the permission of the Court, compound such offence.

(5) No composition of an offence shall be made after the accused has been committed for trial, or, where the case is pending in appeal, without the leave of the Court.

(6) [Sub-section (6) relates to the form of the Table and related particulars.]

(7) No composition shall be permitted where the accused has a previous conviction affecting the sentence liable to be imposed.

(8) The composition of an offence under this section shall have the effect of an acquittal of the accused with whom the offence has been compounded.

(9) No offence shall be compounded except as provided by this section.
