धारा 356 — उद्घोषित अपराधी की अनुपस्थिति में जांच, विचारण या निर्णय
356. (1) जहां किसी व्यक्ति को उद्घोषित अपराधी घोषित किया गया है और वह विचारण से बचने के लिए फरार हो गया है, और उसकी गिरफ्तारी की तुरंत कोई संभावना नहीं है, वहां यह ऐसे व्यक्ति के वैयक्तिक रूप से हाजिर होने और विचारित होने के अधिकार के अध्यर्पण के रूप में प्रचालित समझा जाएगा, और न्यायालय, लिखित रूप में कारण अभिलिखित करने के पश्चात्, आरोप विरचित किए जाने की तारीख से नब्बे दिन बीत जाने पर, उसी रीति से और उसी प्रभाव से जांच या विचारण के साथ आगे बढ़ सकता है मानो वह हाजिर हो।
(2) न्यायालय उपधारा (1) के अधीन आगे बढ़ने के पूर्व निम्नलिखित प्रक्रिया के अनुपालन को सुनिश्चित करेगा, अर्थात्:-
(i) कम से कम तीस दिन के अंतराल पर लगातार दो गिरफ्तारी वारंट जारी किए गए हों;
(ii) अभियुक्त के अंतिम ज्ञात निवास स्थान में प्रचलित किसी राष्ट्रीय या स्थानीय दैनिक समाचार पत्र में एक सूचना का प्रकाशन, जिसमें उसे तीस दिन के भीतर न्यायालय के समक्ष हाजिर होने की अपेक्षा की गई हो;
(iii) यदि ज्ञात हों, तो ऐसे व्यक्ति के नातेदारों या मित्रों को सूचित किया गया हो; और
(iv) ऐसे विचारण की सूचना अभियुक्त के निवास स्थान या सामान्य निवास स्थान के बाहर, साथ ही संबंधित पुलिस थाने में भी, चिपकाई गई हो।
(3) जहां अभियुक्त का कोई विधिक प्रतिनिधित्व नहीं है, वहां न्यायालय राज्य के व्यय पर एक अधिवक्ता उपलब्ध कराएगा।
(4) पहले से परीक्षित साक्षियों का साक्ष्य ऐसे अभियुक्त व्यक्ति के विरुद्ध उसकी अनुपस्थिति में जांच या विचारण में साक्ष्य में दिया जाएगा, और यदि ऐसा व्यक्ति पश्चात् में गिरफ्तार किया जाता है, तो न्यायालय उसे ऐसे साक्षियों की परीक्षा करने की अनुज्ञा दे सकता है।
(5) ऐसे विचारण में साक्षी के अभिसाक्ष्य का श्रव्य-दृश्य अभिलेखन वरीयत: लिया जाएगा।
(6) यदि अभियुक्त व्यक्ति उसकी अनुपस्थिति में संचालित विचारण की समाप्ति पर न्यायालय में हाजिर होता है, तो न्यायालय, न्याय के हित में और लिखित रूप में अभिलिखित किए जाने वाले कारणों से, उस प्रक्रम से आगे विचारण में उसकी और भागीदारी की अनुज्ञा दे सकता है।
(7) इस धारा के अधीन निर्णय के विरुद्ध कोई अपील तब तक नहीं होगी जब तक अपीलार्थी स्वयं को अपीलीय न्यायालय के समक्ष पेश न करे, और दोषसिद्धि के विरुद्ध ऐसी कोई अपील निर्णय की तारीख से तीन वर्ष की अवधि के पश्चात् ग्रहण नहीं की जाएगी।
(8) राज्य सरकार, अधिसूचना द्वारा, यह निदेश दे सकती है कि इस धारा के उपबंध धारा 84 की उपधारा (1) के अधीन उद्घोषित व्यक्ति को भी लागू होंगे।
Section 356 — Inquiry, trial or judgment in absentia of proclaimed offender (English)
356. (1) Where an individual has been declared a proclaimed offender and has absconded to evade trial, and there is no immediate prospect of arresting him, it shall be deemed to operate as a waiver of the right of such person to be present and be tried in person, and the Court, after recording reasons in writing, may proceed with the inquiry or trial in the same manner and with the same effect as if he was present, after the expiry of ninety days from the date of framing of the charge.
(2) The Court shall ensure compliance of the following procedure before proceeding under sub-section (1), namely:-
(i) issuing two consecutive warrants of arrest within an interval of at least thirty days;
(ii) publication of a notice in a national or local daily newspaper circulated in the place of the last known residence of the accused, requiring him to appear before the Court within thirty days;
(iii) informing the relatives or friends of such person, if known; and
(iv) affixing information of such trial outside the residence or place of ordinary residence of the accused, as also in the concerned police station.
(3) Where the accused has no legal representation, the Court shall provide an advocate at the expense of the State.
(4) The evidence of witnesses already examined shall be given in evidence against such accused person in the inquiry or trial in his absence, and if such person is subsequently arrested, the Court may allow him to examine such witnesses.
(5) Audio-video recording of the deposition of the witness in such trial shall be preferably taken.
(6) If the accused person appears in the Court at the conclusion of the trial conducted in his absentia, the Court may, in the interest of justice and for reasons to be recorded in writing, allow further participation in the trial from that stage.
(7) No appeal shall lie against the judgment under this section unless the appellant presents himself before the Appellate Court, and no such appeal against conviction shall be entertained after a period of three years from the date of the judgment.
(8) The State Government may, by notification, direct that the provisions of this section shall also apply to a proclaimed person under sub-section (1) of section 84.
