धारा 355 — कतिपय मामलों में अभियुक्त की अनुपस्थिति में जांच और विचारण किए जाने का उपबंध

355. (1) इस संहिता के अधीन किसी जांच या विचारण के किसी प्रक्रम पर, यदि न्यायाधीश या मजिस्ट्रेट का, अभिलिखित किए जाने वाले कारणों से, यह समाधान हो जाता है कि अभियुक्त की न्यायालय के समक्ष वैयक्तिक हाजिरी न्याय के हितों में आवश्यक नहीं है, या यह कि अभियुक्त कार्यवाही में लगातार बाधा डालता है, तो न्यायाधीश या मजिस्ट्रेट, यदि अभियुक्त किसी अधिवक्ता द्वारा प्रतिनिधित्व किया जाता है, उसकी हाजिरी से अभिमुक्ति दे सकता है और ऐसी जांच या विचारण को उसकी अनुपस्थिति में आगे बढ़ा सकता है।

(2) यदि ऐसे किसी मामले में अभियुक्त किसी अधिवक्ता द्वारा प्रतिनिधित्व नहीं किया जाता है, या यदि न्यायाधीश या मजिस्ट्रेट उसकी वैयक्तिक हाजिरी को आवश्यक समझता है, तो वह, यदि वह ठीक समझे, या तो ऐसी जांच या विचारण को स्थगित कर सकता है, या यह आदेश दे सकता है कि ऐसे अभियुक्त के मामले को पृथक् रूप से लिया जाए या विचारित किया जाए।

स्पष्टीकरण-इस धारा के प्रयोजनों के लिए, अभियुक्त की वैयक्तिक हाजिरी के अंतर्गत श्रव्य-दृश्य इलेक्ट्रॉनिक साधनों के माध्यम से हाजिरी भी है।

Section 355 — Provision for inquiries and trial being held in absence of accused in certain cases (English)

355. (1) At any stage of an inquiry or trial under this Sanhita, if the Judge or Magistrate is satisfied, for reasons to be recorded, that the personal attendance of the accused before the Court is not necessary in the interests of justice, or that the accused persistently disturbs the proceedings in Court, the Judge or Magistrate may, if the accused is represented by an advocate, dispense with his attendance and proceed with such inquiry or trial in his absence.

(2) If the accused in any such case is not represented by an advocate, or if the Judge or Magistrate considers his personal attendance necessary, he may, if he thinks fit, either adjourn such inquiry or trial, or order that the case of such accused be taken up or tried separately.

Explanation.-For the purposes of this section, personal attendance of the accused includes attendance through audio-video electronic means.
