धारा 353 — अभियुक्त व्यक्ति का सक्षम साक्षी होना

353. (1) किसी दांडिक न्यायालय के समक्ष किसी अपराध का अभियुक्त कोई भी व्यक्ति प्रतिरक्षा के लिए सक्षम साक्षी होगा और अपने विरुद्ध, या उसी विचारण में उसके साथ आरोपित किसी अन्य व्यक्ति के विरुद्ध, लगाए गए आरोपों का खंडन करने में शपथ पर साक्ष्य दे सकता है:

परंतु-

(क) उसे उसके अपने लिखित अनुरोध पर के सिवाय साक्षी के रूप में नहीं बुलाया जाएगा; और

(ख) साक्ष्य न देने के उसके असफल रहने को अभियोजन द्वारा किसी टिप्पणी का विषय नहीं बनाया जाएगा और न ही उससे उसके, या उसी विचारण में उसके साथ आरोपित किसी अन्य व्यक्ति के, विरुद्ध कोई उपधारणा उत्पन्न होगी।

(2) वह व्यक्ति, जिसके विरुद्ध इस संहिता के सुसंगत उपबंधों के अधीन कार्यवाहियां संस्थित की गई हैं, ऐसी कार्यवाहियों में स्वयं को साक्षी के रूप में पेश कर सकता है:

परंतु ऐसी कार्यवाही में, जिसे यह उपधारा लागू होती है, ऐसे व्यक्ति का साक्ष्य न देना किसी टिप्पणी का विषय नहीं बनाया जाएगा और न ही उससे उसके विरुद्ध कोई उपधारणा उत्पन्न होगी।

Section 353 — Accused person to be competent witness (English)

353. (1) Any person accused of an offence before a Criminal Court shall be a competent witness for the defence and may give evidence on oath in disproof of the charges made against him or any person charged together with him at the same trial:

Provided that-

(a) he shall not be called as a witness except on his own request in writing; and

(b) his failure to give evidence shall not be made the subject of any comment by the prosecution or give rise to any presumption against himself or any person charged together with him at the same trial.

(2) Any person against whom proceedings are instituted under the relevant provisions of this Sanhita may offer himself as a witness in such proceedings:

Provided that in a proceeding to which this sub-section applies, the failure of such person to give evidence shall not be made the subject of any comment or give rise to any presumption against him.
