धारा 34 — साक्षी को समन

चूंकि मेरे समक्ष यह परिवाद किया गया है कि ............... (अभियुक्त का नाम) निवासी ............... (पता) ने ............... अपराध किया है (या किए जाने का संदेह है) [समय और स्थान सहित अपराध का संक्षेप में कथन करें], और मुझे यह प्रतीत होता है कि आप तात्त्विक साक्ष्य दे सकते हैं या आपके पास कोई ऐसा दस्तावेज या वस्तु है जो उक्त परिवाद के प्रयोजन के लिए आवश्यक है;

आपको एतद्द्वारा अपेक्षित किया जाता है कि आप ............... तारीख को पूर्वाह्न दस बजे इस न्यायालय के समक्ष हाजिर हों, ताकि ऐसा दस्तावेज या वस्तु प्रस्तुत करें या उक्त परिवाद के विषय में जो आप जानते हैं उसकी गवाही दें।

इसमें व्यतिक्रम न करें, क्योंकि यदि आप बिना न्यायसंगत प्रतिवाद के उक्त तारीख को हाजिर होने की उपेक्षा करते हैं या इंकार करते हैं, तो आपकी हाजिरी बाध्य करने के लिए वारंट जारी किया जाएगा।

WHEREAS complaint has been made before me that.................(name of the accused) of..................(address) has (or is suspected to have) committed the offence of...............(state the offence concisely with time and place), and it appears to me that you are likely to give material evidence or have in your possession a document or thing which is necessary for the purpose of the said complaint;

You are hereby required to appear before this Court on the...............day of.................next at ten o'clock in the forenoon, to produce such document or thing or to testify what you know concerning the matter of the said complaint.

Herein fail not, as if you shall, without just excuse, neglect or refuse to appear on the said date, a warrant will be issued to compel your attendance.
