धारा 502 — स्थावर संपत्ति का कब्जा पुनर्स्थापित करने की शक्ति
502. (1) जब किसी व्यक्ति को दांडिक बल, या बल के प्रदर्शन, या दांडिक अपराधन से युक्त अपराध के लिए दोषसिद्ध किया जाता है, और न्यायालय को यह प्रतीत होता है कि, ऐसे बल या बल के प्रदर्शन या अपराधन द्वारा, किसी व्यक्ति को किसी स्थावर संपत्ति से बेकब्जा किया गया है, तो न्यायालय, यदि वह ठीक समझे, यह आदेश दे सकता है कि, आवश्यक होने पर बलपूर्वक, संपत्ति के कब्जे में रहने वाले किसी अन्य व्यक्ति को बेदखल करने के पश्चात्, कब्जा उस व्यक्ति को पुनर्स्थापित किया जाए:
परंतु इस धारा के अधीन ऐसा कोई आदेश दोषसिद्धि की तारीख से एक मास से अधिक समय पर नहीं दिया जाएगा।
(2) जहां अपराध का विचारण करने वाले न्यायालय ने उपधारा (1) के अधीन कोई आदेश नहीं दिया है, वहां अपील, संपुष्टि या पुनरीक्षण का न्यायालय, यदि वह ठीक समझे, अपने समक्ष मामले का व्ययन करते समय ऐसा आदेश दे सकता है।
(3) धारा 500 के उपबंध इस धारा के अधीन दिए गए आदेश को इस प्रकार लागू होंगे जिस प्रकार वे धारा 499 के अधीन दिए गए आदेश को लागू होते हैं।
(4) इस धारा के अधीन दिया गया कोई आदेश किसी ऐसे अधिकार या हित पर प्रतिकूल प्रभाव नहीं डालेगा, जो किसी व्यक्ति ऐसी स्थावर संपत्ति में या उस पर, किसी सिविल वाद में स्थापित करने में समर्थ हो।
Section 502 — Power to restore possession of immovable property (English)
502. (1) When a person is convicted of an offence attended by criminal force, or show of force, or by criminal intimidation, and it appears to the Court that, by such force or show of force or intimidation, any person has been dispossessed of any immovable property, the Court may, if it thinks fit, order that possession of the same be restored to that person after evicting, by force if necessary, any other person who may be in possession of the property:
Provided that no such order shall be made by the Court more than one month after the date of the conviction.
(2) Where the Court trying the offence has not made an order under sub-section (1), the Court of appeal, confirmation or revision may, if it thinks fit, make such order while disposing of the case before it.
(3) The provisions of section 500 shall apply to an order made under this section as they apply to an order made under section 499.
(4) An order made under this section shall not prejudice any right or interest, to or in such immovable property, which any person may be able to establish in a civil suit.
