धारा 497 — कतिपय मामलों में विचारण लंबित रहते संपत्ति की अभिरक्षा और व्ययन का आदेश

497. (1) जब कोई संपत्ति किसी जांच या विचारण के दौरान किसी दांडिक न्यायालय के समक्ष पेश की जाती है, या किसी न्यायालय की अभिरक्षा में है, तब न्यायालय अन्वेषण, जांच या विचारण की समाप्ति लंबित रहते ऐसी संपत्ति की उचित अभिरक्षा के लिए ऐसा आदेश दे सकता है जो वह ठीक समझे, और, यदि संपत्ति शीघ्र और स्वाभाविक क्षय के अधीन है, या यदि ऐसा करना अन्यथा समीचीन है, तो न्यायालय, ऐसा साक्ष्य अभिलिखित करने के पश्चात् जिसे वह आवश्यक समझे, उसके विक्रय या अन्यथा व्ययन का आदेश दे सकता है।

स्पष्टीकरण-इस धारा के प्रयोजनों के लिए, "संपत्ति" के अंतर्गत हैं-

(क) किसी भी प्रकार की संपत्ति या दस्तावेज जो न्यायालय के समक्ष पेश की जाती है या जो उसकी अभिरक्षा में है;

(ख) कोई संपत्ति जिसके संबंध में कोई अपराध किया गया प्रतीत होता है या जो किसी अपराध के किए जाने में उपयोग में लाई गई प्रतीत होती है।

(2) जहां अपराध का अन्वेषण किया जा रहा है और संपत्ति पुलिस द्वारा कुर्क की गई है, वहां न्यायालय या मजिस्ट्रेट, संपत्ति के पेश किए जाने की तारीख से चौदह दिन की अवधि के भीतर, ऐसी संपत्ति का, ऐसे प्ररूप और रीति में जो विहित की जाए, उसके वर्णन सहित एक कथन तैयार करेगा।

(3) न्यायालय या मजिस्ट्रेट, जहां तक संभव हो, संपत्ति के व्ययन, विनाश, समपहरण या परिदान के पूर्व मोबाइल फोन या किसी अन्य इलेक्ट्रॉनिक साधन पर उसका फोटोग्राफ और, यदि आवश्यक हो, वीडियोग्राफ प्राप्त करेगा।

(4) इस धारा के अधीन तैयार किया गया कथन तथा फोटोग्राफ या वीडियोग्राफ, न्यायालय के समक्ष स्वयं संपत्ति के पेश किए जाने के बजाय, किसी जांच, विचारण या अन्य कार्यवाही में साक्ष्य के रूप में उपयोग में लाया जाएगा।

(5) जहां संपत्ति का व्ययन उपधारा (1) के अधीन पहले से नहीं किया गया है, वहां न्यायालय या मजिस्ट्रेट, कथन तैयार किए जाने या फोटोग्राफ या वीडियोग्राफ लिए जाने की तारीख से तीस दिन की अवधि के भीतर, संपत्ति के व्ययन, विनाश, समपहरण या परिदान का आदेश देगा, ऐसी रीति से जो विनिर्दिष्ट की जाए।

Section 497 — Order for custody and disposal of property pending trial in certain cases (English)

497. (1) When any property is produced before any Criminal Court during any inquiry or trial, or is in the custody of any Court, the Court may make such order as it thinks fit for the proper custody of such property pending the conclusion of the investigation, inquiry or trial, and, if the property is subject to speedy and natural decay, or if it is otherwise expedient so to do, the Court may, after recording such evidence as it thinks necessary, order it to be sold or otherwise disposed of.

Explanation.-For the purposes of this section, "property" includes-

(a) property of any kind or document which is produced before the Court or which is in its custody;

(b) any property regarding which an offence appears to have been committed or which appears to have been used for the commission of any offence.

(2) Where the offence is under investigation and property is seized by the police, the Court or Magistrate shall, within a period of fourteen days from the date of production of the property, prepare a statement of such property containing its description in such form and manner as may be prescribed.

(3) The Court or Magistrate shall, as far as possible, get the photograph and, if necessary, videograph of the property on mobile phone or any other electronic device before the disposal, destruction, confiscation or delivery of the property.

(4) The statement and the photograph or videograph prepared or taken under this section shall be used as evidence in any inquiry, trial or other proceeding, instead of the production of the property itself before the Court.

(5) Where the property is not already disposed of under sub-section (1), the Court or Magistrate shall, within a period of thirty days from the date of preparation of the statement or the taking of the photograph or videograph, order the disposal, destruction, confiscation or delivery of such property in the manner as may be specified.
