धारा 498 — विचारण की समाप्ति पर संपत्ति के व्ययन का आदेश

498. (1) जब किसी दांडिक न्यायालय में कोई जांच या विचारण समाप्त हो जाता है, तब न्यायालय, उसके समक्ष पेश की गई या उसकी अभिरक्षा में की किसी संपत्ति या दस्तावेज के, या जिसके संबंध में कोई अपराध किया गया प्रतीत होता है, या जो किसी अपराध के किए जाने में उपयोग में लाई गई है, उसके, विनाश, समपहरण, या उसके कब्जे के हकदार होने का दावा करने वाले किसी व्यक्ति को परिदान, या अन्यथा, द्वारा व्ययन के लिए ऐसा आदेश दे सकता है जो वह ठीक समझे।

(2) इस धारा के अधीन किसी संपत्ति के, उसके कब्जे के हकदार होने का दावा करने वाले किसी व्यक्ति को परिदान के लिए, बंधपत्र सहित या रहित, न्यायालय या मजिस्ट्रेट के, यथास्थिति, समाधानप्रद आदेश दिया जा सकता है, जिसमें उससे यह अपेक्षा की जाए कि यदि इस धारा के अधीन दिया गया आदेश अपील, संपुष्टि या पुनरीक्षण में संशोधित या अपास्त किया जाता है, तो वह ऐसी संपत्ति न्यायालय को वापस करेगा।

(3) सेशन न्यायालय, इस धारा के अधीन स्वयं आदेश देने के बजाय, यह निदेश दे सकता है कि संपत्ति मुख्य न्यायिक मजिस्ट्रेट को परिदत्त की जाए, जो तत्पश्चात् इस अध्याय में उपबंधित रीति से उससे निपटेगा।

(4) जहां संपत्ति पशुधन है या शीघ्र और स्वाभाविक क्षय के अधीन है, या जहां उपधारा (2) के अधीन कोई बंधपत्र निष्पादित किया गया है, उन दशाओं के सिवाय, इस धारा के अधीन दिया गया आदेश दो मास तक निष्पादित नहीं किया जाएगा, या, यदि कोई अपील प्रस्तुत की जाती है, तब तक जब तक ऐसी अपील का व्ययन न हो जाए।

(5) इस धारा में, "संपत्ति" पद के अंतर्गत, जिस संपत्ति के संबंध में कोई अपराध किया गया प्रतीत होता है, उसकी दशा में, न केवल वह संपत्ति है जो मूलतः किसी पक्षकार के कब्जे या नियंत्रण में रही है, अपितु वह भी है जिसमें या जिसके लिए वह परिवर्तित या विनिमित की गई हो, और ऐसे परिवर्तन या विनिमय द्वारा अर्जित कोई वस्तु भी, चाहे तुरंत या अन्यथा।

Section 498 — Order for disposal of property at conclusion of trial (English)

498. (1) When an inquiry or trial in any Criminal Court is concluded, the Court may make such order as it thinks fit for the disposal, by destruction, confiscation, or delivery to any person claiming to be entitled to possession thereof or otherwise, of any property or document produced before it or in its custody, or regarding which any offence appears to have been committed, or which has been used for the commission of any offence.

(2) An order may be made under this section for the delivery of any property to any person claiming to be entitled to the possession thereof, with or without a bond, to the satisfaction of the Court or the Magistrate, as the case may be, requiring him to restore such property to the Court if the order made under this section is modified or set aside on appeal, confirmation or revision.

(3) A Court of Session may, instead of itself making an order under this section, direct the property to be delivered to the Chief Judicial Magistrate, who shall thereupon deal with it in the manner provided in this Chapter.

(4) Except where the property is livestock or is subject to speedy and natural decay, or where a bond has been executed under sub-section (2), an order made under this section shall not be carried out for two months, or, if an appeal is presented, until such appeal has been disposed of.

(5) In this section, the term "property" includes, in the case of property regarding which an offence appears to have been committed, not merely such property as has been originally in the possession or under the control of any party, but also any property into or for which the same may have been converted or exchanged, and anything acquired by such conversion or exchange, whether immediately or otherwise.
