धारा 394 — पूर्व दोषसिद्ध अपराधी का पता सूचित करने का आदेश
394. (1) जब कोई व्यक्ति, जो भारत में किसी न्यायालय द्वारा तीन वर्ष या उससे अधिक की अवधि के कारावास से दंडनीय अपराध के लिए दोषसिद्ध किया जा चुका है, द्वितीय वर्ग के मजिस्ट्रेट से भिन्न किसी न्यायालय द्वारा पुनः तीन वर्ष या उससे अधिक की अवधि के कारावास से दंडनीय किसी अपराध के लिए दोषसिद्ध किया जाता है, तो ऐसा न्यायालय, यदि वह ठीक समझे, ऐसे व्यक्ति को कारावास का दंडादेश पारित करते समय, यह भी आदेश दे सकता है कि उसका निवास स्थान और छूटने के पश्चात् ऐसे निवास में कोई परिवर्तन या उससे अनुपस्थिति, इसमें इसके पश्चात् उपबंधित रीति से, ऐसे दंडादेश की समाप्ति की तारीख से पांच वर्ष से अनधिक की अवधि के लिए सूचित की जाए।
(2) उपधारा (1) के उपबंध ऐसे अपराधों को करने के दांडिक षड्यंत्रों तथा ऐसे अपराधों के दुष्प्रेरण को भी लागू होंगे।
(3) यदि ऐसी दोषसिद्धि अपील में या अन्यथा अपास्त कर दी जाती है, तो ऐसा आदेश शून्य हो जाएगा।
(4) इस धारा के अधीन कोई आदेश अपीलीय न्यायालय द्वारा, या उच्च न्यायालय या सेशन न्यायालय द्वारा अपनी पुनरीक्षण शक्तियों का प्रयोग करते समय भी दिया जा सकता है।
(5) राज्य सरकार, अधिसूचना द्वारा, अपराधियों द्वारा निवास सूचित किए जाने से संबंधित इस धारा के उपबंधों को कार्यान्वित करने के लिए नियम बना सकती है।
(6) ऐसे नियम उसके उल्लंघन के लिए दंड का उपबंध कर सकते हैं, और ऐसे उल्लंघनों का विचारण उस जिले के सक्षम अधिकारिता वाले मजिस्ट्रेट द्वारा किया जाएगा जिसमें उल्लंघन होता है।
Section 394 — Order for notifying address of previously convicted offender (English)
394. (1) When any person, having been convicted by a Court in India of an offence punishable with imprisonment for a term of three years, or upwards, is again convicted of any offence punishable with imprisonment for a term of three years or upwards by any Court other than that of a Magistrate of the second class, such Court may, if it thinks fit, at the time of passing a sentence of imprisonment on such person, also order that his residence and any change of, or absence from, such residence after release be notified as hereinafter provided, for a term not exceeding five years from the date of the expiration of such sentence.
(2) The provisions of sub-section (1) shall also apply to criminal conspiracies to commit such offences and to the abetment of such offences.
(3) If such conviction is set aside on appeal or otherwise, such order shall become void.
(4) An order under this section may also be made by an Appellate Court or by the High Court or Court of Session when exercising its powers of revision.
(5) The State Government may, by notification, make rules to carry out the provisions of this section relating to the notification of residence by offenders.
(6) Such rules may provide for penalties for breach thereof and such rules shall be tried by a Magistrate of competent jurisdiction in the district in which the breach occurs.
