धारा 392 — निर्णय

392. न्यायालय, विचारण की समाप्ति के पश्चात्, निर्णय को खुले न्यायालय में, या तो विचारण की समाप्ति के तुरंत पश्चात्, या किसी पश्चात्वर्ती समय पर, जो पैंतालीस दिन से अधिक न हो, जिसकी सूचना पक्षकारों या उनके अधिवक्ताओं को दी जाएगी, निम्नलिखित रीति में से किसी एक द्वारा उद्घोषित करेगा-

(क) संपूर्ण निर्णय की उद्घोषणा करके; या

(ख) निर्णय को पढ़कर सुनाकर; या

(ग) निर्णय के परिचालक भाग को पढ़कर सुनाकर और निर्णय के सार को ऐसी भाषा में स्पष्ट करके जिसे अभियुक्त या उसका अधिवक्ता समझता हो।

जहां निर्णय खंड (क) में वर्णित रीति में परिदत्त किया जाता है, वहां पीठासीन अधिकारी उसे शॉर्टहैंड में लिखवाएगा, जैसे ही अनुलेख तैयार हो जाए उस पर और उसके प्रत्येक पृष्ठ पर हस्ताक्षर करेगा, और खुले न्यायालय में निर्णय के परिदान की तारीख का उल्लेख करेगा। जहां निर्णय या उसका परिचालक भाग उसके स्वयं के हाथ से लिखा नहीं गया है, वहां निर्णय के प्रत्येक पृष्ठ पर पीठासीन अधिकारी के हस्ताक्षर होंगे।

जहां निर्णय खंड (ग) के अधीन स्पष्ट किया जाता है, वहां संपूर्ण निर्णय या उसकी प्रति पक्षकारों या उनके अधिवक्ताओं के अवलोकन के लिए तुरंत नि:शुल्क उपलब्ध कराई जाएगी, और न्यायालय, जहां तक व्यवहार्य हो, निर्णय की तारीख से सात दिन की अवधि के भीतर निर्णय की प्रति पोर्टल पर अपलोड करेगा।

अभिरक्षा में अभियुक्त को, निर्णय की उद्घोषणा सुनने के लिए, या तो वैयक्तिक रूप से या श्रव्य-दृश्य इलेक्ट्रॉनिक साधनों के माध्यम से, लाया जाएगा। अभिरक्षा में न रहने वाला अभियुक्त हाजिर होगा, जब तक उसकी वैयक्तिक हाजिरी से अभिमुक्ति न दी गई हो, जिस दशा में परिदत्त किए जाने वाले निर्णय को सुनने के लिए उसका हाजिर होना आवश्यक नहीं होगा, जब तक वह दोषमुक्ति का निर्णय न हो या केवल जुर्माना अधिरोपित करने वाला दंडादेश न हो।

किसी दांडिक न्यायालय द्वारा परिदत्त कोई निर्णय, केवल इस कारण से अविधिमान्य नहीं समझा जाएगा कि उसके परिदान के लिए अधिसूचित दिन या स्थान से किसी पक्षकार या उसके अधिवक्ता की अनुपस्थिति थी, या पक्षकारों या उनके अधिवक्ताओं में से किसी को, ऐसे दिन और स्थान की सूचना तामील करने में कोई लोप या दोष था।

इस धारा की कोई बात धारा 511 के प्रवर्तन को किसी भी रीति से सीमित या प्रभावित करने वाली नहीं समझी जाएगी।

Section 392 — Judgment (English)

392. The Court, after the termination of the trial, shall pronounce the judgment in open court, either immediately after the termination of the trial or at some subsequent time not exceeding forty-five days, of which notice shall be given to the parties or their advocates, by-

(a) delivering the whole of the judgment; or

(b) reading out the whole of the judgment; or

(c) reading out the operative part of the judgment and explaining the substance of the judgment in a language which is understood by the accused or his advocate.

Where the judgment is delivered in the manner mentioned in clause (a), the presiding officer shall cause it to be taken down in shorthand, sign the transcript and every page thereof as soon as the transcript is made ready, and mention the date of delivery of the judgment in open court. Where the judgment or the operative part thereof is not written with his own hand, every page of the judgment shall be signed by the presiding officer.

Where the judgment is explained under clause (c), the entire judgment or a copy thereof shall be immediately made available for the perusal of the parties or their advocates free of cost, and the Court shall as far as practicable, upload the copy of the judgment on the portal within a period of seven days from the date of judgment.

An accused who is in custody shall be brought up to hear the judgment pronounced, either in person or through audio-video electronic means. An accused who is not in custody shall attend, unless his personal attendance has been dispensed with, in which case he need not attend to hear the judgment delivered, unless it is a judgment of acquittal or one imposing a sentence of fine only.

No judgment delivered by any Criminal Court shall be deemed to be invalid by reason only of the absence of any party or his advocate on the day or from the place notified for the delivery thereof, or of any omission to serve, or defect in serving, on the parties or their advocates, or any of them, the notice of such day and place.

Nothing in this section shall be construed to limit or affect in any way the operation of section 511.
