धारा 345 — क्षमादान की शर्तों का पालन न करने वाले व्यक्ति का विचारण
345. (1) जहां लोक अभियोजक यह प्रमाणित करता है कि, उसकी राय में, धारा 343 या धारा 344 के अधीन क्षमादान की निविदा स्वीकार करने वाले किसी व्यक्ति ने, या तो किसी तात्त्विक बात को जानबूझकर छिपाकर या मिथ्या साक्ष्य देकर, उस शर्त का पालन नहीं किया है जिस पर निविदा की गई थी, वहां ऐसे व्यक्ति पर उस अपराध के लिए, जिसके संबंध में इस प्रकार क्षमादान की निविदा की गई थी, या उसी विषय से संबंधित किसी अन्य अपराध के लिए, जिसके लिए वह दोषी प्रतीत होता है, और मिथ्या साक्ष्य देने के अपराध के लिए भी, अभियोजन चलाया जा सकता है:
परंतु ऐसे व्यक्ति का विचारण अन्य किसी अभियुक्त के साथ संयुक्त रूप से नहीं किया जाएगा।
(2) मिथ्या साक्ष्य देने के अपराध के लिए किसी अभियोजन को उच्च न्यायालय की मंजूरी के बिना ग्रहण नहीं किया जाएगा।
(3) क्षमादान की निविदा स्वीकार करते समय ऐसे व्यक्ति द्वारा किया गया और धारा 183 के अधीन किसी मजिस्ट्रेट द्वारा, या धारा 306 की उपधारा (4) के अधीन किसी न्यायालय द्वारा, अभिलिखित कोई कथन, इस धारा के अधीन उसके विचारण में उसके विरुद्ध साक्ष्य में दिया जा सकता है।
(4) ऐसे विचारण में, अभियुक्त यह तर्क करने का हकदार होगा कि उसने उस शर्त का पालन किया है जिस पर ऐसी निविदा की गई थी।
(5) ऐसे मामले में, यह साबित करने का भार कि शर्त का पालन नहीं किया गया है, अभियोजन पर होगा, और न्यायालय, मामले में साक्ष्य लेने के पूर्व, अभियुक्त से यह पूछेगा कि क्या वह यह तर्क करता है कि उसने क्षमादान की निविदा की शर्तों का पालन किया है, और यदि अभियुक्त यह तर्क करता है कि उसने ऐसी शर्तों का पालन किया है, और न्यायालय, साक्ष्य लेने और पक्षकारों को सुनने के पश्चात्, यह पाता है कि अभियुक्त ने शर्तों का पालन किया है, तो वह दोषमुक्ति का निर्णय पारित करेगा।
Section 345 — Trial of person not complying with conditions of pardon (English)
345. (1) Where a Public Prosecutor certifies that, in his opinion, any person who has accepted a tender of pardon under section 343 or section 344 has, either by wilfully concealing anything essential or by giving false evidence, not complied with the condition on which the tender was made, such person may be tried for the offence in respect of which the pardon was so tendered or for any other offence of which he appears to have been guilty in connection with the same matter, and also for the offence of giving false evidence:
Provided that such person shall not be tried jointly with any of the other accused.
(2) No prosecution for the offence of giving false evidence shall be entertained except with the sanction of the High Court.
(3) Any statement made by such person accepting the tender of pardon and recorded by a Magistrate under section 183 or by a Court under sub-section (4) of section 306, may be given in evidence against him at his trial under this section.
(4) At such trial, the accused shall be entitled to plead that he has complied with the condition upon which such tender was made.
(5) In such case, the burden of proving that the condition has not been complied with shall be upon the prosecution, and the Court shall, before taking evidence in the case, ask the accused whether he pleads that he has complied with the conditions on which the tender of pardon was made, and if the accused pleads that he has complied with such conditions, and the Court, after taking evidence and hearing the parties, finds that the accused has complied with the conditions, it shall pass judgment of acquittal.
