धारा 343 — सहअपराधी को क्षमादान की निविदा
343. (1) इस धारा के लागू होने वाले किसी अपराध में प्रत्यक्ष या अप्रत्यक्ष रूप से संबद्ध या उसमें भागी होना समझे जाने वाले किसी व्यक्ति का साक्ष्य अभिप्राप्त करने की दृष्टि से, मुख्य न्यायिक मजिस्ट्रेट या प्रथम वर्ग का मजिस्ट्रेट, अपराध के अन्वेषण, जांच या विचारण के किसी प्रक्रम पर, ऐसे व्यक्ति को, अपराध से संबंधित सब परिस्थितियों के, जो उसकी जानकारी में हैं, तथा उसमें प्रधान या दुष्प्रेरक के रूप में संबद्ध प्रत्येक अन्य व्यक्ति के, पूर्ण और सत्य प्रकटन की शर्त पर, क्षमादान की निविदा कर सकता है।
(2) यह धारा उन अपराधों को लागू होती है जो केवल सेशन न्यायालय द्वारा, या किसी विधि के अधीन नियुक्त विशेष न्यायाधीश के न्यायालय द्वारा, विचारणीय हैं, और उन अपराधों को जो सात वर्ष तक के कारावास से, या उससे अधिक कठोर दंडादेश से, दंडनीय हैं।
(3) उपधारा (1) के अधीन क्षमादान की निविदा करने वाला प्रत्येक मजिस्ट्रेट अपने ऐसा करने के कारणों को अभिलिखित करेगा, और, अभियुक्त द्वारा किए गए आवेदन पर, उसे ऐसे अभिलेख की एक प्रतिलिपि नि:शुल्क देगा, और यह भी अभिलिखित करेगा कि निविदा उस व्यक्ति द्वारा, जिसे वह की गई थी, स्वीकार की गई थी या नहीं।
(4) इस धारा के अधीन क्षमादान की निविदा स्वीकार करने वाला प्रत्येक व्यक्ति, अपराध का संज्ञान लेने वाले मजिस्ट्रेट के न्यायालय में, और, यदि कोई हो, पश्चात्वर्ती विचारण में, साक्षी के रूप में परीक्षित किया जाएगा, और, यदि वह पहले से जमानत पर नहीं है, तो उसे विचारण की समाप्ति तक अभिरक्षा में निरुद्ध रखा जाएगा।
(5) जहां किसी व्यक्ति ने क्षमादान की निविदा स्वीकार कर ली है और उपधारा (4) के अधीन उसकी परीक्षा हो गई है, वहां अपराध का संज्ञान लेने वाला मजिस्ट्रेट, मामले में कोई और जांच किए बिना,-
(क) यदि अपराध केवल सेशन न्यायालय द्वारा विचारणीय है या यदि संज्ञान लेने वाला मजिस्ट्रेट मुख्य न्यायिक मजिस्ट्रेट है, तो उसे सेशन न्यायालय को विचारण के लिए सुपुर्द करेगा;
(ख) किसी अन्य मामले में, उसे मुख्य न्यायिक मजिस्ट्रेट को अंतरित करेगा, जो स्वयं मामले का विचारण करेगा।
Section 343 — Tender of pardon to accomplice (English)
343. (1) With a view to obtaining the evidence of any person supposed to have been directly or indirectly concerned in or privy to an offence to which this section applies, the Chief Judicial Magistrate or a Magistrate of the first class may, at any stage of the investigation or inquiry into, or the trial of, the offence, tender a pardon to such person on condition of his making a full and true disclosure of the whole of the circumstances within his knowledge relative to the offence and to every other person concerned, whether as principal or abettor, in the commission thereof.
(2) This section applies to offences triable exclusively by the Court of Session or by the Court of a Special Judge appointed under any law, and offences punishable with imprisonment which may extend to seven years or with a more severe sentence.
(3) Every Magistrate who tenders a pardon under sub-section (1) shall record his reasons for so doing, and shall, on application made by the accused, furnish him with a copy of such record free of cost, and shall also record whether the tender was or was not accepted by the person to whom it was made.
(4) Every person accepting a tender of pardon under this section shall be examined as a witness in the Court of the Magistrate taking cognizance of the offence and in the subsequent trial, if any, and shall, unless he is already on bail, be detained in custody until the termination of the trial.
(5) Where a person has accepted a tender of pardon and has been examined under sub-section (4), the Magistrate taking cognizance of the offence shall, without making any further inquiry in the case,-
(a) commit it for trial to the Court of Session if the offence is triable exclusively by that Court or if the Magistrate taking cognizance is the Chief Judicial Magistrate;
(b) in any other case, make over the case to the Chief Judicial Magistrate who shall try the case himself.
