धारा 337 — एक बार दोषसिद्ध या दोषमुक्त व्यक्ति का उसी अपराध के लिए पुनः विचारण न किया जाना

337. (1) एक बार किसी सक्षम अधिकारिता वाले न्यायालय द्वारा किसी अपराध के लिए विचारित और उस अपराध का दोषसिद्ध या दोषमुक्त किया गया व्यक्ति, जब तक ऐसी दोषसिद्धि या दोषमुक्ति प्रवृत्त रहती है, उसी अपराध के लिए, या उन्हीं तथ्यों पर किसी अन्य अपराध के लिए, जिसके लिए पूर्व विचारण में उसके विरुद्ध भिन्न आरोप बनाया जा सकता था, या जिसके लिए वह उस विचारण में दोषसिद्ध किया जा सकता था, पुनः विचारण के दायी नहीं होगा।

(2) किसी अपराध का दोषमुक्त या दोषसिद्ध किया गया व्यक्ति, राज्य सरकार की सम्मति से, किसी ऐसे भिन्न अपराध के लिए, जिसके लिए पूर्व विचारण में पृथक् आरोप बनाया जा सकता था, पश्चात् में विचारित किया जा सकता है।

(3) किसी ऐसे कार्य द्वारा गठित अपराध का दोषसिद्ध व्यक्ति, जिसके परिणाम, उस कार्य के साथ मिलकर, उस अपराध से भिन्न अपराध गठित करते हैं जिसका वह दोषसिद्ध किया गया था, बाद में ऐसे अंतिम-उल्लिखित अपराध के लिए विचारित किया जा सकता है, यदि दोषसिद्धि के समय वे परिणाम नहीं हुए थे, या न्यायालय को उनके होने की जानकारी नहीं थी।

(4) किसी कार्य द्वारा गठित अपराध का दोषमुक्त या दोषसिद्ध व्यक्ति, ऐसी दोषमुक्ति या दोषसिद्धि के होते हुए भी, उन्हीं कार्यों द्वारा गठित किसी अन्य अपराध के लिए, जो उसने किया हो, पश्चात् में आरोपित और विचारित किया जा सकता है, यदि जिस न्यायालय द्वारा उसका पहला विचारण किया गया था वह उस अपराध का विचारण करने के लिए सक्षम नहीं था जिसके लिए वह पश्चात् में आरोपित किया गया है।

(5) उन्मोचित किया गया व्यक्ति उसी अपराध के लिए पुनः विचारित नहीं किया जाएगा, सिवाय उस न्यायालय की सम्मति के जिसके द्वारा वह उन्मोचित किया गया था, या किसी अन्य न्यायालय की सम्मति के जिसके अधीनस्थ पहला न्यायालय है।

(6) इस धारा की कोई बात साधारण खंड अधिनियम, 1897 के तत्संबंधी व्यावृत्ति-उपबंधों पर, तथा इस संहिता के अन्य लागू उपबंधों पर, प्रभाव नहीं डालेगी।

स्पष्टीकरण-किसी परिवाद की खारिजी, या अभियुक्त का उन्मोचन, इस धारा के प्रयोजनों के लिए दोषमुक्ति नहीं है।

[इस धारा के पश्चात् अधिनियम में दृष्टांत (क) से (च) दिए गए हैं जो उपधारा (1) से (4) के प्रयोग को उत्तरोत्तर विचारणों की विभिन्न तथ्य-स्थितियों पर दर्शाते हैं।]

Section 337 — Person once convicted or acquitted not to be tried for same offence (English)

337. (1) A person who has once been tried by a Court of competent jurisdiction for an offence and convicted or acquitted of such offence shall, while such conviction or acquittal remains in force, not be liable to be tried again for the same offence, nor on the same facts for any other offence for which a different charge might have been made against him at the former trial, or for which he might have been convicted at that trial.

(2) A person acquitted or convicted of any offence may afterwards be tried, with the consent of the State Government, for any distinct offence for which a separate charge might have been made against him at the former trial.

(3) A person convicted of any offence constituted by any act causing consequences which, together with such act, constituted a different offence from that of which he was convicted, may afterwards be tried for such last-mentioned offence, if the consequences had not happened, or were not known to the Court to have happened, at the time when he was convicted.

(4) A person acquitted or convicted of any offence constituted by any acts may, notwithstanding such acquittal or conviction, be subsequently charged with, and tried for, any other offence constituted by the same acts which he may have committed, if the Court by which he was first tried was not competent to try the offence with which he is subsequently charged.

(5) A person discharged shall not be tried again for the same offence except with the consent of the Court by which he was discharged or of any other Court to which the first-mentioned Court is subordinate.

(6) Nothing in this section shall affect the corresponding savings provisions of the General Clauses Act, 1897 and other applicable provisions of this Sanhita.

Explanation.-The dismissal of a complaint, or the discharge of the accused, is not an acquittal for the purposes of this section.
