धारा 336 — कतिपय मामलों में लोक सेवकों, विशेषज्ञों, पुलिस अधिकारियों का साक्ष्य

336. जहां किसी लोक सेवक, वैज्ञानिक विशेषज्ञ या चिकित्सा अधिकारी द्वारा तैयार किया गया कोई दस्तावेज या रिपोर्ट इस संहिता के अधीन किसी जांच, विचारण या अन्य कार्यवाही में साक्ष्य के रूप में उपयोग में लाई जाती है, और ऐसे लोक सेवक, वैज्ञानिक विशेषज्ञ या चिकित्सा अधिकारी का स्थानांतरण हो गया है, वह सेवानिवृत्त हो गया है, सेवा में नहीं रहा है, मर गया है या अनुपलब्ध है या यह असंभाव्य है कि वह मिल सकेगा या उसकी हाजिरी, मामले की परिस्थितियों में, ऐसी विलंब, व्यय या असुविधा के बिना, जो अयुक्तियुक्त होगी, प्राप्त नहीं की जा सकती, वहां न्यायालय उसके उत्तरवर्ती अधिकारी को, जो उस समय उस पद पर है, उक्त दस्तावेज या रिपोर्ट की विषय-वस्तु के संबंध में पेश होने और गवाही देने के लिए बुलाएगा:

परंतु ऐसे किसी उत्तरवर्ती अधिकारी को तब तक गवाही देने के लिए नहीं बुलाया जाएगा जब तक कि दस्तावेज या रिपोर्ट किसी पक्षकार द्वारा विवादित न हो:

परंतु यह और भी कि उत्तरवर्ती अधिकारी दस्तावेज या रिपोर्ट की विषय-वस्तु के संबंध में श्रव्य-दृश्य इलेक्ट्रॉनिक साधनों के माध्यम से भी गवाही दे सकता है।

Section 336 — Evidence of public servants, experts, police officers in certain cases (English)

336. Where any document or report prepared by a public servant, scientific expert or medical officer is used as evidence in any inquiry, trial or other proceeding under this Sanhita, and such public servant, scientific expert or medical officer has been transferred, retired, ceased to be in service, is dead or not available or it is unlikely that he can be found or that his attendance cannot be procured without an amount of delay, expense or inconvenience which, under the circumstances of the case, would be unreasonable, the Court shall call upon his successor-in-office who is holding that post at the time to produce and depose with regard to the contents of the said document or report:

Provided that no such successor-in-office shall be called upon to depose without the document or report having been disputed by any of the parties:

Provided further that the successor-in-office may also depose with regard to the contents of the document or report through audio-video electronic means.
