धारा 479 — विचाराधीन बंदी को अधिकतम कितनी अवधि तक निरुद्ध रखा जा सकता है

479. (1) जहां किसी व्यक्ति ने, किसी विधि के अधीन किसी अपराध की इस संहिता के अधीन अन्वेषण, जांच या विचारण की अवधि के दौरान (जो ऐसा अपराध नहीं है जिसके लिए उस विधि के अधीन मृत्यु या आजीवन कारावास का दंड, दंडों में से एक के रूप में विनिर्दिष्ट है), उस विधि के अधीन ऐसे अपराध के लिए विनिर्दिष्ट अधिकतम कारावास की अवधि के आधे तक विस्तारित अवधि के लिए निरोध भुगत लिया है, वहां वह न्यायालय द्वारा जमानत पर छोड़ा जाएगा:

परंतु जहां ऐसा व्यक्ति प्रथम बार का अपराधी है (जो अतीत में किसी अपराध के लिए कभी दोषसिद्ध नहीं किया गया है), वहां वह न्यायालय द्वारा बंधपत्र पर छोड़ा जाएगा, यदि उसने उस विधि के अधीन ऐसे अपराध के लिए विनिर्दिष्ट अधिकतम कारावास की अवधि के एक-तिहाई तक विस्तारित अवधि के लिए निरोध भुगत लिया है:

परंतु यह और भी कि न्यायालय, लोक अभियोजक को सुनने के पश्चात् और अपने द्वारा लिखित रूप में अभिलिखित किए जाने वाले कारणों से, ऐसे व्यक्ति के निरंतर निरोध का आदेश उक्त अवधि के आधे से अधिक अवधि के लिए दे सकता है या उसे प्रतिभुओं सहित या रहित वैयक्तिक बंधपत्र के बजाय जमानत पर छोड़ सकता है:

परंतु यह भी कि किसी भी व्यक्ति को किसी भी दशा में अन्वेषण, जांच या विचारण की अवधि के दौरान उस विधि के अधीन उक्त अपराध के लिए उपबंधित अधिकतम कारावास की अवधि से अधिक निरुद्ध नहीं किया जाएगा।

स्पष्टीकरण-जमानत मंजूर करने के लिए इस धारा के अधीन निरोध की अवधि की संगणना करने में, अभियुक्त द्वारा कारित कार्यवाही में विलंब से हुई निरोध की अवधि अपवर्जित की जाएगी।

(2) उपधारा (1) में किसी बात के होते हुए भी, जहां किसी व्यक्ति के विरुद्ध एक से अधिक अपराध में या बहु मामलों में अन्वेषण, जांच या विचारण लंबित है, वहां वह न्यायालय द्वारा जमानत पर नहीं छोड़ा जाएगा।

(3) कारागार अधीक्षक, जब ऐसे व्यक्ति द्वारा भुगती गई निरोध की अवधि, यथास्थिति, ऐसे अपराध के लिए विनिर्दिष्ट अधिकतम कारावास की अवधि के आधे या एक-तिहाई के बराबर हो जाती है, तब उसे जमानत पर छोड़े जाने के प्रयोजन के लिए तुरंत न्यायालय को लिखित रूप में एक आवेदन करेगा।

Section 479 — Maximum period for which undertrial prisoner can be detained (English)

479. (1) Where a person has, during the period of investigation, inquiry or trial under this Sanhita of an offence under any law (not being an offence for which the punishment of death or imprisonment for life has been specified as one of the punishments under that law) undergone detention for a period extending up to one-half of the maximum period of imprisonment specified for such offence under that law, he shall be released by the Court on bail:

Provided that where such person is a first-time offender (who has never been convicted of any offence in the past) he shall be released on bond by the Court, if he has undergone detention for the period extending up to one-third of the maximum period of imprisonment specified for such offence under that law:

Provided further that the Court may, after hearing the Public Prosecutor and for reasons to be recorded by it in writing, order the continued detention of such person for a period longer than one-half of the said period or release him on bail instead of the personal bond with or without sureties:

Provided also that no person shall in any case be detained during the period of investigation, inquiry or trial for more than the maximum period of imprisonment provided for the said offence under that law.

Explanation.-In computing the period of detention under this section for granting bail, the period of detention caused by the delay in proceeding caused by the accused shall be excluded.

(2) Notwithstanding anything contained in sub-section (1), where an investigation, inquiry or trial in more than one offence or in multiple cases is pending against a person, he shall not be released on bail by the Court.

(3) The Superintendent of Jail shall, when the period of detention undergone by such person equals one-half or one-third, as the case may be, of the maximum period of imprisonment specified for such offence, forthwith make an application in writing to the Court for the purpose of releasing such person on bail.
