धारा 472 — मृत्युदंड के मामलों में दया याचिका
472. (1) मृत्युदंड का दोषसिद्ध व्यक्ति, या उसका विधिक वारिस, या कोई नातेदार, कारागार अधीक्षक द्वारा उसे (i) उच्चतम न्यायालय द्वारा अपील, पुनर्विलोकन या विशेष इजाजत याचिका की खारिजी, या (ii) उच्च न्यायालय द्वारा मृत्युदंड की संपुष्टि और अपील अधिमानित करने के लिए अनुज्ञात अवधि की समाप्ति, की सूचना दिए जाने की तारीख से तीस दिन के भीतर, संविधान के अनुच्छेद 72 के अधीन राष्ट्रपति के समक्ष, या संविधान के अनुच्छेद 161 के अधीन राज्यपाल के समक्ष, दया याचिका फाइल कर सकता है।
(2) दया याचिका पहले राज्यपाल के समक्ष फाइल की जाएगी, और यदि नामंजूर की जाती है, तो राज्यपाल के विनिश्चय के साठ दिन के भीतर राष्ट्रपति के समक्ष फाइल की जा सकती है।
(3) कारागार अधीक्षक यह सुनिश्चित करेगा कि जहां एक ही मामले में एक से अधिक दोषसिद्ध व्यक्ति दंडादेशित हैं, वहां ऐसे सभी दोषसिद्ध व्यक्ति साठ दिन के भीतर अपनी दया याचिकाएं, यदि कोई हों, फाइल करें; उस अवधि के भीतर किसी दोषसिद्ध व्यक्ति से कोई याचिका प्राप्त न होने की दशा में, अधीक्षक मामले का ब्योरा, प्राप्त किसी याचिका सहित, केंद्रीय या राज्य सरकार को, यथास्थिति, भेजेगा।
(4) केंद्रीय सरकार राज्य सरकार की टिप्पणियां मांगेगी और राज्य सरकार की टिप्पणियां तथा कारागार अभिलेख प्राप्त होने के साठ दिन के भीतर अपनी सिफारिश राष्ट्रपति को अग्रेषित करेगी।
(5) राष्ट्रपति याचिका पर विचार करेगा और विनिश्चय करेगा, और जहां एक ही मामले में एक से अधिक दोषसिद्ध व्यक्ति संबद्ध हैं, वहां उनकी याचिकाएं न्याय के हित में एक साथ विनिश्चित की जाएंगी।
(6) याचिका पर राष्ट्रपति के आदेश के अड़तालीस घंटे के भीतर, केंद्रीय सरकार उसका संचार राज्य के गृह विभाग और संबंधित कारागार अधीक्षक को करेगी।
(7) इस धारा के अधीन राष्ट्रपति या राज्यपाल के आदेश के विरुद्ध किसी न्यायालय में कोई अपील नहीं होगी, और कोई भी न्यायालय इस बात की जांच नहीं करेगा कि राष्ट्रपति या राज्यपाल ने, यथास्थिति, संविधान के अनुच्छेद 72 या अनुच्छेद 161 के अधीन अपनी शक्तियों का प्रयोग किस रीति से किया है।
Section 472 — Mercy petition in death sentence cases (English)
472. (1) A convict under sentence of death, or his legal heir, or any relative, may file a mercy petition before the President under article 72 of the Constitution, or before the Governor under article 161 of the Constitution, within thirty days from the date on which the Superintendent of Jail informs him of- (i) the dismissal of an appeal, review or special leave petition by the Supreme Court; or (ii) the confirmation of the sentence of death by the High Court and the expiry of the period allowed for preferring an appeal.
(2) The mercy petition shall first be filed before the Governor, and if rejected, may be filed before the President within sixty days of the Governor's decision.
(3) The Superintendent of Jail shall ensure that where more than one convict is sentenced in the same case, all such convicts file their mercy petitions, if any, within sixty days; in case of non-receipt of any petition from any convict within that period, the Superintendent shall send the case details, along with any petition received, to the Central or State Government, as the case may be.
(4) The Central Government shall seek the comments of the State Government and shall, within sixty days of receiving the State Government's comments and the jail records, forward its recommendation to the President.
(5) The President shall consider and decide the petition, and where more than one convict is involved in the same case, their petitions shall be decided together in the interest of justice.
(6) Within forty-eight hours of the President's order on the petition, the Central Government shall communicate the same to the State Home Department and the Superintendent of the Jail concerned.
(7) No appeal shall lie to any Court against an order of the President or the Governor made under this section, and no Court shall inquire into the manner in which the President or the Governor has exercised his powers under article 72 or article 161 of the Constitution, as the case may be.
