धारा 477 — कतिपय मामलों में राज्य सरकार का केंद्रीय सरकार की सहमति के पश्चात् कार्य करना
477. (1) धारा 473 और धारा 474 द्वारा राज्य सरकार को दंडादेश परिहृत या लघुकृत करने के लिए प्रदत्त शक्तियां, किसी ऐसे मामले में जहां दंडादेश ऐसे अपराध के लिए है-
(क) जिसका अन्वेषण इस संहिता से भिन्न किसी केंद्रीय अधिनियम के अधीन अपराध का अन्वेषण करने के लिए सशक्त किसी एजेंसी द्वारा किया गया था; या
(ख) जो केंद्रीय सरकार की किसी संपत्ति के दुर्विनियोग या विनाश या क्षति से संबंधित था; या
(ग) जो केंद्रीय सरकार की सेवा में किसी व्यक्ति द्वारा अपने पदीय कर्तव्य के निर्वहन में कार्य करते हुए या ऐसा करना तात्पर्यित करते हुए किया गया था,
राज्य सरकार द्वारा केंद्रीय सरकार की सहमति के पश्चात् के सिवाय प्रयोग में नहीं लाई जाएंगी।
(2) जहां किसी व्यक्ति को उन अपराधों के लिए दोषसिद्ध किया गया है जिनमें से कुछ ऐसे विषयों से संबंधित हैं जिन तक संघ की कार्यपालक शक्ति विस्तृत है और कुछ ऐसे विषयों से संबंधित हैं जिन तक राज्य की कार्यपालक शक्ति विस्तृत है, वहां ऐसे व्यक्ति पर पारित दंडादेश के स्थगन, परिहार या लघुकरण का कोई आदेश राज्य सरकार द्वारा, उन अपराधों के संबंध में, जिनके लिए संघ की कार्यपालक शक्ति विस्तृत है, केंद्रीय सरकार की सहमति के पश्चात् के सिवाय नहीं किया जाएगा।
Section 477 — State Government to act after concurrence with Central Government in certain cases (English)
477. (1) The powers conferred by sections 473 and 474 upon the State Government to remit or commute a sentence, in any case where the sentence is for an offence-
(a) which was investigated by any agency empowered to make investigation into an offence under any Central Act other than this Sanhita; or
(b) which involved the misappropriation or destruction of, or damage to, any property belonging to the Central Government; or
(c) which was committed by a person in the service of the Central Government while acting or purporting to act in the discharge of his official duty,
shall not be exercised by the State Government except after concurrence with the Central Government.
(2) Where any person has been convicted of offences some of which relate to matters to which the executive power of the Union extends and some of which relate to matters to which the executive power of the State extends, no order of suspension, remission or commutation of the sentence passed on such person shall be made by the State Government in relation to such sentence, insofar as it relates to the offences in respect of which the executive power of the Union extends, except after concurrence with the Central Government.
