धारा 469 — व्यावृत्ति

469. (1) धारा 466 या धारा 467 की कोई बात किसी व्यक्ति को उसकी पूर्व या पश्चात्वर्ती दोषसिद्धि पर, जिस दंड का वह दायी है, उसके किसी भाग से क्षमा करने वाली नहीं समझी जाएगी।

(2) जब जुर्माने के भुगतान में व्यतिक्रम के लिए कारावास किसी सारवान् कारावास के दंडादेश के साथ संलग्न है, और अपराधी सारवान् दंडादेश भुगत रहा है, वहां व्यतिक्रम-कारावास तब तक प्रभावी नहीं होगा जब तक सारवान् दंडादेश समाप्त न हो जाए, उन मामलों में जिनमें उसे व्यतिक्रम-कारावास भुगतने के पूर्व कोई आगे का सारवान् दंडादेश या दंडादेश भुगतना है। यह धारा अध्याय 34 भाग 2 (धारा 462-469) को पूर्ण करती है।

Section 469 — Saving (English)

469. (1) Nothing in section 466 or section 467 shall be held to excuse any person from any part of the punishment to which he is liable upon his former or subsequent conviction.

(2) When a sentence of imprisonment in default of payment of a fine is annexed to a substantive sentence of imprisonment, and the offender is undergoing the substantive sentence, the imprisonment in default shall not take effect until the substantive sentence has expired, in cases where he is required to undergo a further substantive sentence or sentences before undergoing the imprisonment in default.
