धारा 434 — अपील पर निर्णयों और आदेशों की अंतिमता

434. अपील पर अपीलीय न्यायालय द्वारा पारित निर्णय और आदेश अंतिम होंगे, सिवाय धारा 418, धारा 419, धारा 425 की उपधारा (4) या अध्याय 32 में उपबंधित मामलों के:

परंतु इस धारा की कोई बात अपीलीय न्यायालय को, धारा 419 के अधीन प्रस्तुत दोषमुक्ति के विरुद्ध अपील, या धारा 418 के अधीन प्रस्तुत दंडादेश-वृद्धि के लिए अपील, उसी मामले से उत्पन्न दोषसिद्धि के विरुद्ध अपील के अंतिम व्ययन के होते हुए भी, सुनने और व्ययित करने से नहीं रोकेगी।

Section 434 — Finality of judgments and orders on appeal (English)

434. Judgments and orders passed by an Appellate Court upon an appeal shall be final, except in the cases provided for in section 418, section 419, sub-section (4) of section 425 or Chapter XXXII:

Provided that nothing in this section shall prevent an Appellate Court from hearing and disposing of an appeal against acquittal presented under section 419 or an appeal for enhancement of sentence presented under section 418, notwithstanding final disposal of an appeal against conviction arising from the same case.
