धारा 433 — अपील-न्यायालय के न्यायाधीशों की राय समान रूप से विभाजित होने पर प्रक्रिया

433. जब इस अध्याय के अधीन कोई अपील उच्च न्यायालय द्वारा न्यायाधीशों की एक खंडपीठ के समक्ष सुनी जाती है और ऐसे न्यायाधीशों की राय विभाजित है, तब अपील, उनकी रायों सहित, आगे सुनवाई और राय देने के लिए उस न्यायालय के किसी अन्य न्यायाधीश के समक्ष रखी जाएगी, और वह न्यायाधीश, ऐसी सुनवाई के पश्चात् जो वह ठीक समझे, अपनी राय देगा, और निर्णय या आदेश ऐसी राय का अनुसरण करेगा:

परंतु यदि खंडपीठ बनाने वाले न्यायाधीशों में से किसी एक द्वारा, या, जहां इस धारा के अधीन अपील किसी अन्य न्यायाधीश के समक्ष रखी गई है, उस न्यायाधीश द्वारा, ऐसा अपेक्षित किया जाता है, तो अपील न्यायाधीशों की एक बड़ी खंडपीठ द्वारा पुनः सुनी और विनिश्चित की जाएगी।

Section 433 — Procedure where Judges of Court of appeal are equally divided (English)

433. When an appeal under this Chapter is heard by a High Court before a Bench of Judges and such Judges are divided in opinion, the appeal, with their opinions, shall be laid before another Judge of that Court, and such Judge shall, after such hearing as he thinks fit, deliver his opinion, and the judgment or order shall follow such opinion:

Provided that if one of the Judges constituting the Bench, or, where the appeal is laid before another Judge under this section, that Judge, so requires, the appeal shall be re-heard and decided by a larger Bench of Judges.
