धारा 404 — अभियुक्त और अन्य व्यक्तियों को निर्णय की प्रति दिया जाना

404. (1) जब अभियुक्त को कारावास का दंडादेश दिया जाता है, तब निर्णय की उद्घोषणा के तुरंत पश्चात्, उसे निर्णय की एक प्रति नि:शुल्क दी जाएगी।

(2) अभियुक्त के आवेदन पर, निर्णय की प्रमाणित प्रति, या यदि वह चाहे, यदि व्यवहार्य हो तो अपनी स्वयं की भाषा में, या न्यायालय की भाषा में, अनुवाद, उसे बिना विलंब के दिया जाएगा, और ऐसी प्रति, प्रत्येक ऐसे मामले में जहां निर्णय अपीलनीय है, नि:शुल्क दी जाएगी:

परंतु, जहां उच्च न्यायालय द्वारा मृत्युदंड पारित या संपुष्ट किया जाता है, वहां निर्णय की प्रमाणित प्रति अभियुक्त को तुरंत नि:शुल्क दी जाएगी, चाहे वह उसके लिए आवेदन करे या नहीं।

(3) उपधारा (2) के उपबंध धारा 136 के अधीन किसी आदेश को भी लागू होंगे।

(4) जब किसी न्यायालय द्वारा अभियुक्त को मृत्युदंड दिया जाता है और ऐसे निर्णय से अधिकारपूर्वक अपील होती है, तब न्यायालय उसे उस अवधि के बारे में सूचित करेगा जिसके भीतर, यदि वह अपील करना चाहता है, तो उसकी अपील अधिमानित की जानी चाहिए।

(5) जहां अभियुक्त को कारावास का दंडादेश नहीं दिया गया है, और जहां अभियुक्त से भिन्न, निर्णय से प्रभावित कोई व्यक्ति निर्णय की, या अभिलेख के किसी आदेश, अभिसाक्ष्य या अन्य भाग की प्रति चाहता है, वहां ऐसा न्यायालय, इस निमित्त उसके पास किए गए आवेदन पर और विहित प्रभारों के भुगतान पर, ऐसे व्यक्ति को उसकी प्रति दे सकता है, यदि उसकी राय में ऐसा व्यक्ति निर्णय या आदेश से प्रभावित है, या विशेष कारणों से उसे नि:शुल्क अनुदत्त कर सकता है। मामले का संचालन करने वाले प्रत्येक लोक अभियोजक या सहायक लोक अभियोजक को निर्णय की एक प्रति, जैसे ही वह उद्घोषित की जाती है, नि:शुल्क दी जाएगी।

(6) उच्च न्यायालय, नियमों द्वारा, दांडिक न्यायालय के किसी निर्णय या आदेश की प्रतियां किसी ऐसे व्यक्ति को, जो निर्णय या आदेश से प्रभावित नहीं है, विहित फीसों के भुगतान पर, और उच्च न्यायालय द्वारा बनाई जाने वाली ऐसी शर्तों के अधीन रहते हुए, देने का उपबंध कर सकता है।

Section 404 — Copy of judgment to be given to accused and other persons (English)

404. (1) When the accused is sentenced to imprisonment, a copy of the judgment shall immediately, after the pronouncement of the judgment, be given to him free of cost.

(2) On the application of the accused, a certified copy of the judgment, or when he so desires, a translation in his own language if practicable or in the language of the Court, shall be given to him without delay, and such copy shall, in every case where the judgment is appealable, be given free of cost:

Provided that, where a sentence of death is passed or confirmed by the High Court, a certified copy of the judgment shall be immediately given to the accused free of cost, whether or not he applies for the same.

(3) The provisions of sub-section (2) shall apply also to any order under section 136.

(4) When the accused is sentenced to death by any Court and an appeal lies from such judgment as of right, the Court shall inform him of the period within which, if he wishes to appeal, his appeal should be preferred.

(5) Where the accused is not sentenced to imprisonment, and where a person, other than the accused, affected by the judgment desires to have a copy of the judgment or of any order, deposition or other part of the record, such Court may, on application made to it in this behalf and on payment of the prescribed charges, give a copy of the same to such person, if in its opinion such person is affected by the judgment or order, or grant it for special reasons free of cost. Every Public Prosecutor or Assistant Public Prosecutor conducting a case shall be furnished, free of cost, with a copy of the judgment as soon as it is pronounced.

(6) The High Court may, by rules, provide for the grant of copies of any judgment or order of a Criminal Court to any person who is not affected by a judgment or order, on payment of prescribed fees, and subject to such conditions as the High Court may make.
