धारा 401 — सदाचार की परिवीक्षा पर या भर्त्सना के पश्चात् छोड़े जाने का आदेश

401. (1) जब इक्कीस वर्ष से कम आयु का न होने वाला कोई व्यक्ति सात वर्ष या उससे कम की अवधि के कारावास से दंडनीय किसी अपराध के लिए दोषसिद्ध किया जाता है, या जब इक्कीस वर्ष से कम आयु का कोई व्यक्ति या कोई स्त्री मृत्यु या आजीवन कारावास से दंडनीय न होने वाले किसी अपराध के लिए दोषसिद्ध की जाती है, और अपराधी के विरुद्ध कोई पूर्व दोषसिद्धि साबित नहीं है, यदि उस न्यायालय को, जिसके समक्ष वह दोषसिद्ध किया जाता है, अपराधी की आयु, चरित्र या पूर्व इतिहास, तथा उन परिस्थितियों को, जिनमें अपराध किया गया था, ध्यान में रखते हुए, यह प्रतीत होता है कि अपराधी को सदाचार की परिवीक्षा पर छोड़ा जाना समीचीन है, तो, इस संहिता में अन्यत्र किसी बात के होते हुए भी, न्यायालय, उसे तुरंत कोई दंड देने के बजाय, यह निदेश दे सकता है कि उसे, प्रतिभुओं सहित या रहित बंधपत्र निष्पादित करने पर, तीन वर्ष से अनधिक की ऐसी अवधि के लिए, जो न्यायालय निदेशित करे, अपेक्षित किए जाने पर हाजिर होने और दंडादेश प्राप्त करने के लिए, तथा इस बीच शांति बनाए रखने और सदाचारी बने रहने के लिए, छोड़ दिया जाए।

(2) जहां मामला ऐसा है जिसमें अपराधी के साथ उपधारा (1) के अधीन व्यवहार किया जा सकता था यदि उसका विचारण प्रथम वर्ग के मजिस्ट्रेट द्वारा किया गया होता, और उसका विचारण ऐसे मजिस्ट्रेट द्वारा किया जाता है जो उस उपधारा के अधीन उसका विचारण करने के लिए सशक्त नहीं है, वहां मामले का विचारण करने वाला मजिस्ट्रेट, उपशामक परिस्थितियों को अभिलिखित करने के पश्चात्, उसे आदेशों के लिए प्रथम वर्ग के मजिस्ट्रेट के पास भेज सकता है, और वह मजिस्ट्रेट, जिसे मामला इस प्रकार भेजा जाता है, यदि वह ठीक समझे, स्वयं उससे इस प्रकार निपट सकता है मानो मामले का विचारण उसके द्वारा किया गया हो, या ऐसी आगे की जांच कर सकता है जो वह ठीक समझे।

(3) जब कोई व्यक्ति चोरी, बेईमानी से दुर्विनियोग, छल या भारतीय न्याय संहिता, 2023 के अधीन किसी ऐसे अपराध के लिए, जो दो वर्ष से अधिक न होने वाली अवधि के कारावास से दंडनीय है, या केवल जुर्माने से दंडनीय किसी अपराध के लिए, दोषसिद्ध किया जाता है, और उसके विरुद्ध कोई पूर्व दोषसिद्धि साबित नहीं है, तो न्यायालय, अपराधी की आयु, चरित्र, पूर्व इतिहास या शारीरिक या मानसिक स्थिति को, तथा अपराध की तुच्छ प्रकृति या उन उपशामक परिस्थितियों को, जिनमें अपराध किया गया था, ध्यान में रखते हुए, उसे कोई दंड देने के बजाय, सम्यक् भर्त्सना के पश्चात् छोड़ सकता है।

(4) उपधारा (1) या उपधारा (3) के अधीन कोई आदेश अपीलीय न्यायालय द्वारा, या उच्च न्यायालय या सेशन न्यायालय द्वारा अपनी पुनरीक्षण शक्तियों का प्रयोग करते समय भी दिया जा सकता है।

(5) जब इस धारा के अधीन किसी अपराधी के संबंध में कोई आदेश दिया गया है, तब उच्च न्यायालय या सेशन न्यायालय, अपील में या अपनी पुनरीक्षण शक्ति के प्रयोग में, ऐसे आदेश को अपास्त कर सकता है और ऐसा कोई दंडादेश पारित कर सकता है जो ऐसा अपराधी प्राप्त कर सकता था यदि यह धारा लागू न की गई होती, किंतु वह उससे अधिक नहीं होगा जो उस न्यायालय की शक्ति के भीतर होता जिसने उसे दोषसिद्ध किया था।

(6) से (10) तक प्रतिभू, उसके निबंधनों, छोड़े गए अपराधी की निवास और रिपोर्टिंग अपेक्षाओं, बंधपत्र के उल्लंघन पर अपराधी की गिरफ्तारी की रीति, वारंट जारी करने की प्रक्रियाओं, तथा युवा अपराधियों के लिए अन्य पुनर्वास विधियों की प्रयोज्यता के परिरक्षण से संबंधित उपबंध अंतर्विष्ट हैं।

Section 401 — Order to release on probation of good conduct or after admonition (English)

401. (1) When any person not under twenty-one years of age is convicted of an offence punishable with imprisonment for a term of seven years or less, or when any person under twenty-one years of age or any woman is convicted of an offence not punishable with death or imprisonment for life, and no previous conviction is proved against the offender, if it appears to the Court before which he is convicted, regard being had to the age, character or antecedents of the offender, and to the circumstances in which the offence was committed, that it is expedient that the offender should be released on probation of good conduct, then, notwithstanding anything contained elsewhere in this Sanhita, the Court may, instead of sentencing him at once to any punishment, direct that he be released on his entering into a bond, with or without sureties, to appear and receive sentence when called upon during such period, not exceeding three years, as the Court may direct, and in the meantime to keep the peace and be of good behaviour.

(2) Where the case is one in which the offender could have been dealt with under sub-section (1) had it been tried by a Magistrate of the first class, and it is tried by a Magistrate who is not empowered to try it under that sub-section, the Magistrate trying the case may, after recording the extenuating circumstances, forward it to a Magistrate of the first class for orders, and the Magistrate to whom the case is so forwarded may, if he thinks fit, deal with it himself as if the case had been tried by him, or make such further inquiry as he thinks fit.

(3) When any person is convicted of theft, dishonest misappropriation, cheating or any offence under the Bharatiya Nyaya Sanhita, 2023, punishable with imprisonment for not more than two years, or any offence punishable with fine only, and no previous conviction is proved against him, the Court may, having regard to the age, character, antecedents or physical or mental condition of the offender and to the trivial nature of the offence or any extenuating circumstances under which the offence was committed, instead of sentencing him to any punishment, release him after due admonition.

(4) An order under sub-section (1) or sub-section (3) may also be made by an Appellate Court or by the High Court or Court of Session when exercising its powers of revision.

(5) When an order has been made under this section in respect of any offender, the High Court or Court of Session may, on appeal or in the exercise of its power of revision, set aside such order and pass any sentence which such offender could have received if this section had not been applied, but not exceeding what would have been within the powers of the Court which convicted him.

(6) to (10) contain provisions relating to the surety, its terms, the residence and reporting requirements of the released offender, the manner of arrest of the offender on breach of bond, procedures for issue of warrant, and preservation of the applicability of other rehabilitation laws for young offenders.
