धारा 400 — असंज्ञेय मामलों में व्यय के भुगतान का आदेश

400. (1) जब कभी कोई परिवादी किसी असंज्ञेय अपराध का दोषसिद्ध किया जाता है, तब न्यायालय, उस पर अधिरोपित दंड के अतिरिक्त, यह आदेश दे सकता है कि वह अभियुक्त को, या अभियुक्त परिवादी को, संपूर्ण रूप से या भाग रूप से, अभियोजन में उसके द्वारा उपगत व्यय का भुगतान करे, और, भुगतान में व्यतिक्रम होने पर, ऐसे व्यक्ति को तीस दिन से अनधिक अवधि के साधारण कारावास का दंडादेश दे सकता है; और ऐसे व्यय के अंतर्गत प्रक्रिया-फीस, साक्षियों और अधिवक्ता की फीस के संबंध में उपगत ऐसे व्यय हो सकते हैं जिन्हें न्यायालय युक्तियुक्त समझे।

(2) इस धारा के अधीन कोई आदेश अपीलीय न्यायालय द्वारा, या उच्च न्यायालय या सेशन न्यायालय द्वारा अपनी पुनरीक्षण शक्तियों का प्रयोग करते समय भी दिया जा सकता है।

Section 400 — Order to pay costs in non-cognizable cases (English)

400. (1) Whenever any complainant is convicted of any non-cognizable offence, the Court may, in addition to the penalty imposed upon him, order him to pay to the accused, or the accused to pay to the complainant, in whole or in part, the cost incurred by him in the prosecution, and, in default of payment, sentence such person to simple imprisonment for a term not exceeding thirty days; and such costs may include any expenses incurred in respect of process-fees, witnesses and pleader's fees which the Court may consider reasonable.

(2) An order under this section may also be made by an Appellate Court or by the High Court or Court of Session when exercising its powers of revision.
