धारा 369 — अन्वेषण या विचारण लंबित रहते विकृतचित्त व्यक्ति का उन्मोचन
369. (1) जब कभी धारा 367 या धारा 368 के अधीन किसी व्यक्ति को विकृतचित्तता या बौद्धिक निःशक्तता के कारण प्रतिरक्षा करने में असमर्थ पाया जाता है, तब मजिस्ट्रेट या न्यायालय, यथास्थिति, इस बात की पर्याप्त प्रतिभूति दिए जाने पर कि उसकी उचित देखभाल की जाएगी और उसे स्वयं को या किसी अन्य व्यक्ति को क्षति पहुंचाने से रोका जाएगा, और अपेक्षित होने पर मजिस्ट्रेट या न्यायालय के समक्ष उसकी हाजिरी के लिए, तथा नियमित मनश्चिकित्सीय उपचार के वचनबंध के साथ, ऐसे व्यक्ति को जमानत पर छोड़े जाने का आदेश देगा।
(2) यदि जमानत नहीं दी जा सकती है या ऐसा वचनबंध उपलब्ध नहीं है, तो अभियुक्त को ऐसे स्थान पर रखा जाएगा जहां नियमित मनश्चिकित्सीय उपचार उपलब्ध कराया जा सके, और की गई कार्रवाई मजिस्ट्रेट या न्यायालय द्वारा राज्य सरकार को रिपोर्ट की जाएगी, मानसिक स्वास्थ्य देखभाल अधिनियम, 2017 के उपबंधों के अनुपालन के अधीन रहते हुए।
(3) मजिस्ट्रेट या न्यायालय, कृत्य की प्रकृति और असमर्थता की मात्रा को ध्यान में रखते हुए, यह भी विचार करेगा कि क्या पर्याप्त प्रतिभूति दिए जाने पर अभियुक्त को उन्मोचित किया जा सकता है, या क्या उसे देखभाल, उपचार और प्रशिक्षण के लिए विकृतचित्तता या बौद्धिक निःशक्तता वाले व्यक्तियों के लिए आवासीय सुविधा में भेजा जाना है।
Section 369 — Release of person of unsound mind pending investigation or trial (English)
369. (1) Whenever a person is found under section 367 or section 368 to be incapable of making his defence by reason of unsoundness of mind or intellectual disability, the Magistrate or Court, as the case may be, shall order the release of such person on bail, provided sufficient security is given that he will be properly taken care of and prevented from doing injury to himself or to any other person, and for his appearance when required before the Magistrate or Court, along with an undertaking for regular psychiatric treatment.
(2) If bail cannot be granted or such undertaking is not available, the accused shall be kept in such place where regular psychiatric treatment can be provided, and the action taken shall be reported by the Magistrate or Court to the State Government, subject to compliance with the provisions of the Mental Healthcare Act, 2017.
(3) The Magistrate or Court shall further consider, having regard to the nature of the act and the degree of incapacity, whether the accused may be discharged if sufficient security is given, or whether he is to be sent to a residential facility for persons with unsoundness of mind or intellectual disability for care, treatment and training.
