धारा 368 — न्यायालय के समक्ष विचारित विकृतचित्त व्यक्ति की दशा में प्रक्रिया

368. (1) यदि न्यायालय को, उसके समक्ष किसी व्यक्ति के विचारण के किसी प्रक्रम पर, यह प्रतीत होता है कि ऐसा व्यक्ति विकृतचित्त व्यक्ति है और परिणामस्वरूप अपनी प्रतिरक्षा करने में असमर्थ है, तो न्यायालय, कार्यवाहियों को स्थगित करने के पूर्व, सर्वप्रथम ऐसी विकृतचित्तता और असमर्थता के तथ्य की जांच करेगा, और चिकित्सीय साक्ष्य के आधार पर उस पर एक निष्कर्ष अभिलिखित करेगा।

(2) न्यायालय अभियुक्त को देखभाल और उपचार के लिए किसी शासकीय अस्पताल या शासकीय चिकित्सा महाविद्यालय के मनोचिकित्सक या नैदानिक मनोवैज्ञानिक के पास निर्देशित करेगा, तथा धारा 367 में उपबंधित रीति से मनश्चिकित्सा इकाई के प्रमुख और मनश्चिकित्सा के संकाय सदस्य से मिलकर बने चिकित्सा बोर्ड के समक्ष अपील का उपबंध होगा।

(3) असमर्थता अवधारित करने के पश्चात्, न्यायालय अभियोजन द्वारा पेश किए गए साक्ष्य के अभिलेख की परीक्षा करेगा, और, यदि वह पाता है कि कोई प्रथमदृष्ट्या मामला नहीं बनता है, तो वह अभियुक्त को उन्मोचित करेगा और धारा 369 के अधीन उसके साथ व्यवहार करेगा; अन्यथा, विचारण उपचार के लिए अपेक्षित अवधि के लिए स्थगित किया जाएगा।

(4) जहां प्रथमदृष्ट्या मामला बनता है किंतु अभियुक्त बौद्धिक निःशक्तता के कारण अपनी प्रतिरक्षा करने में असमर्थ पाया जाता है, वहां मजिस्ट्रेट या न्यायालय यह आदेश देगा कि अभियुक्त के साथ धारा 369 के अनुसार व्यवहार किया जाए।

Section 368 — Procedure in case of person of unsound mind tried before Court (English)

368. (1) If it appears to the Court, at any stage of the trial of a person before it, that such person is a person of unsound mind and consequently incapable of making his defence, the Court shall in the first instance try the fact of such unsoundness and incapacity, and record a finding on the same on the basis of medical evidence, before postponing the proceedings.

(2) The Court shall refer the accused to a psychiatrist or clinical psychologist of a Government hospital or Government medical college for care and treatment, with provision for an appeal before a Medical Board consisting of the head of a psychiatry unit and a faculty member in psychiatry, as provided in section 367.

(3) After determining the incapacity, the Court shall examine the record of evidence produced by the prosecution and, if it finds that no prima facie case is made out, it shall discharge the accused and deal with him under section 369; otherwise, the trial shall be postponed for the period required for treatment.

(4) Where a prima facie case is made out but the accused is found incapable of making his defence by reason of intellectual disability, the Magistrate or Court shall order that the accused be dealt with in accordance with section 369.
