धारा 523 — नियम बनाने की उच्च न्यायालय की शक्ति

523. (1) प्रत्येक उच्च न्यायालय, राज्य सरकार के पूर्व अनुमोदन से, निम्नलिखित का उपबंध करने वाले नियम बना सकता है-

(क) वे व्यक्ति जिन्हें अपने अधीनस्थ न्यायालयों में याचिका-लेखक के रूप में कार्य करने की अनुज्ञा दी जा सकती है;

(ख) ऐसे व्यक्तियों का लाइसेंसीकरण, उनके द्वारा व्यवसाय का संचालन, और उनके द्वारा प्रभारित की जाने वाली फीस की अनुसूची;

(ग) नियमों के किसी उल्लंघन के लिए दंड का अधिरोपण, और वह प्राधिकारी जिसके द्वारा ऐसे उल्लंघन की जांच की जा सकती है और दंड अधिरोपित किए जा सकते हैं;

(घ) ऐसे व्यक्तियों द्वारा उन्हें दिए गए प्रमाणपत्रों या लाइसेंसों का प्रदर्शन, और उनके द्वारा तैयार किए गए किसी दस्तावेज की तत्समक्षक; और

(ङ) कोई अन्य विषय जिसे राज्य सरकार विहित किए जाने का निदेश दे।

(2) इस धारा के अधीन बनाए गए सब नियम शासकीय राजपत्र में प्रकाशित किए जाएंगे।

Section 523 — Power of High Court to make rules (English)

523. (1) Every High Court may, with the previous approval of the State Government, make rules providing for-

(a) the persons who may be permitted to act as petition-writers in the Courts subordinate to it;

(b) the licensing of such persons, the conduct of business by them, and the scale of fees to be charged by them;

(c) the imposition of penalties for any breach of the rules, and the authority by which such breach may be investigated and penalties imposed;

(d) the exhibition, by such persons, of certificates or licences granted to them, and the identification of any documents drawn up by them; and

(e) any other matter which the State Government may direct to be prescribed.

(2) All rules made under this section shall be published in the Official Gazette.
