धारा 521 — कोर्ट-मार्शल द्वारा विचारणीय व्यक्तियों का समादेशक अधिकारियों को परिदान
521. (1) केंद्रीय सरकार, इस संहिता, सेना अधिनियम, 1950, नौसेना अधिनियम, 1957 और वायु सेना अधिनियम, 1950 के अनुरूप, उन मामलों के संबंध में नियम बना सकती है जिनमें व्यक्तियों का विचारण उस न्यायालय द्वारा किया जाएगा जिसे यह संहिता लागू होती है, या कोर्ट-मार्शल द्वारा; और, जब किसी व्यक्ति को किसी मजिस्ट्रेट के समक्ष लाया जाता है और किसी ऐसे अपराध का आरोप लगाया जाता है जिसके लिए वह उस न्यायालय द्वारा, जिसे यह संहिता लागू होती है, या कोर्ट-मार्शल द्वारा विचारणीय है, वहां ऐसा मजिस्ट्रेट ऐसे नियमों को ध्यान में रखेगा, और समुचित मामलों में उसे, उस अपराध के कथन सहित जिसका वह अभियुक्त है, कोर्ट-मार्शल द्वारा विचारण के प्रयोजन के लिए, उस यूनिट के, जिससे वह संबद्ध है, समादेशक अधिकारी को, या, यथास्थिति, निकटतम सैन्य, नौसैनिक या वायु सेना स्टेशन के समादेशक अधिकारी को, परिदत्त करेगा।
स्पष्टीकरण-(क) इस धारा में, "यूनिट" के अंतर्गत रेजिमेंट, कोर, पोत, टुकड़ी, समूह, बटालियन या कंपनी है।
(ख) "कोर्ट-मार्शल" के अंतर्गत सेना अधिनियम, 1950, नौसेना अधिनियम, 1957, वायु सेना अधिनियम, 1950, या किसी अन्य तत्संबंधी विधि के अधीन समान या तत्समान शक्तियों वाला कोई अधिकरण है।
(2) प्रत्येक मजिस्ट्रेट, किसी यूनिट या स्टेशन, जिसमें ऐसा व्यक्ति अंतर्विष्ट है या उपस्थित है, के समादेशक अधिकारी द्वारा इस प्रयोजन के लिए किए गए लिखित आवेदन की प्राप्ति पर, ऐसे व्यक्ति को अभिगृहीत करने और सुरक्षित करने के अपने सर्वोत्तम प्रयास करेगा।
(3) उच्च न्यायालय, यदि वह ठीक समझे, यह निदेश दे सकता है कि सिविल कारागार में निरुद्ध कोई बंदी विचारण के लिए कोर्ट-मार्शल के समक्ष, या तत्समक्षक या किसी अन्य प्रयोजन के लिए किसी अधिकारी के समक्ष, लाया जाए, चाहे कोर्ट-मार्शल या अधिकारी उस उच्च न्यायालय की अधिकारिता की स्थानीय सीमाओं के भीतर अपनी बैठक करता हो या करने वाला हो या अपने कृत्यों का प्रयोग करता हो या नहीं।
Section 521 — Delivery to commanding officers of persons liable to be tried by Court-martial (English)
521. (1) The Central Government may make rules consistent with this Sanhita and the Army Act, 1950, the Navy Act, 1957 and the Air Force Act, 1950, as to the cases in which persons shall be tried by a Court to which this Sanhita applies, or by a Court-martial; and, when any person is brought before a Magistrate and charged with an offence for which he is liable to be tried either by a Court to which this Sanhita applies, or by a Court-martial, such Magistrate shall have regard to such rules, and shall in proper cases deliver him, together with a statement of the offence of which he is accused, to the commanding officer of the unit to which he belongs, or to the commanding officer of the nearest military, naval or air force station, as the case may be, for the purpose of being tried by Court-martial.
Explanation.-(a) In this section, "unit" includes a regiment, corps, ship, detachment, group, battalion or company.
(b) "Court-martial" includes any tribunal with the same or analogous powers under the Army Act, 1950, the Navy Act, 1957, the Air Force Act, 1950, or any other corresponding law.
(2) Every Magistrate shall, on receiving a written application for that purpose by the commanding officer of any unit or station in which such person is contained or is present, use his utmost endeavours to apprehend and secure such person.
(3) A High Court may, if it thinks fit, direct that a prisoner detained in a civil prison be brought before a Court-martial for trial or before an officer for the purpose of identification or any other purpose, whether or not the Court-martial or officer is held or is to hold its or his sitting or to exercise his functions within the local limits of that High Court's jurisdiction.
