धारा 425 — अपील का संक्षिप्त खारिजी
425. (1) अपीलीय न्यायालय, धारा 423 या धारा 424 के अधीन अपील की याचिका प्राप्त होने पर, यदि यह विचार करता है कि हस्तक्षेप के लिए पर्याप्त आधार नहीं हैं, तो अपील को संक्षेपतः खारिज कर सकता है:
परंतु-
(क) धारा 423 के अधीन किसी अपीलार्थी को सुने जाने का युक्तियुक्त अवसर दिए बिना संक्षेपतः खारिज नहीं किया जाएगा;
(ख) धारा 424 के अधीन किसी अपीलार्थी को सुने जाने का युक्तियुक्त अवसर दिए बिना संक्षेपतः खारिज नहीं किया जाएगा, जब तक अपीलीय न्यायालय यह न समझे कि अपील तुच्छ है या यह कि अभिरक्षा में अभियुक्त को न्यायालय के समक्ष प्रस्तुत करने में ऐसी असुविधा होगी जो मामले की परिस्थितियों में अननुपातिक होगी;
(ग) धारा 424 के अधीन प्रस्तुत किसी अपील को तब तक संक्षेपतः खारिज नहीं किया जाएगा जब तक ऐसी अपील अधिमानित करने के लिए अनुज्ञात अवधि समाप्त न हो जाए।
(2) इस धारा के अधीन कोई अपील खारिज करने के पूर्व, न्यायालय मामले का अभिलेख मंगवा सकता है।
(3) जहां अपीलीय न्यायालय सेशन न्यायालय या मुख्य न्यायिक मजिस्ट्रेट है, वहां वह, यदि उपधारा (1) के अधीन कोई अपील खारिज करता है, तो अपने ऐसा करने के कारण अभिलिखित करेगा।
(4) जहां धारा 424 के अधीन प्रस्तुत कोई अपील इस धारा के अधीन संक्षेपतः खारिज कर दी गई है और अपीलीय न्यायालय यह पाता है कि अपीलार्थी द्वारा धारा 423 के अधीन कोई अन्य अपील फाइल की गई है, वहां वह न्यायालय, यदि वह आवश्यक समझे, उस अपील को सुन सकता है।
Section 425 — Summary dismissal of appeal (English)
425. (1) The Appellate Court, on receiving the petition of appeal under section 423 or section 424, may, if it considers that there is no sufficient ground for interfering, dismiss the appeal summarily:
Provided that-
(a) an appellant under section 423 shall not be dismissed summarily except after giving him a reasonable opportunity of being heard;
(b) an appellant under section 424 shall not be dismissed summarily except after giving him a reasonable opportunity of being heard, unless the Appellate Court considers that the appeal is frivolous or that the production of the accused in custody before the Court would involve such inconvenience as would be disproportionate in the circumstances of the case;
(c) no appeal presented under section 424 shall be dismissed summarily until the period allowed for preferring such appeal has expired.
(2) Before dismissing an appeal under this section, the Court may call for the record of the case.
(3) Where the Appellate Court is a Court of Session or the Chief Judicial Magistrate, it shall, if it dismisses an appeal under sub-section (1), record its reasons for doing so.
(4) Where an appeal presented under section 424 has been dismissed summarily under this section and the Appellate Court finds that another appeal has been filed under section 423 by the appellant, that Court may, if it considers necessary, hear that appeal.
