धारा 419 — दोषमुक्ति के मामले में अपील

419. (1) जिला मजिस्ट्रेट, किसी संज्ञेय और अजमानतीय अपराध के संबंध में किसी मजिस्ट्रेट द्वारा पारित दोषमुक्ति के आदेश के विरुद्ध सेशन न्यायालय में अपील प्रस्तुत करने के लिए लोक अभियोजक को निदेश दे सकता है।

(2) जहां दोषमुक्ति का ऐसा आदेश उच्च न्यायालय से भिन्न किसी न्यायालय द्वारा किसी मामले में पारित किया जाता है, वहां राज्य सरकार लोक अभियोजक को उच्च न्यायालय में अपील प्रस्तुत करने का निदेश दे सकती है।

(3) जहां ऐसे अपराध का अन्वेषण किसी केंद्रीय अधिनियम के अधीन उसका अन्वेषण करने के लिए सशक्त किसी एजेंसी द्वारा किया गया है, वहां केंद्रीय सरकार भी, उन्हीं शर्तों के अधीन, उपधारा (2) के अधीन अपील प्रस्तुत करने के लिए लोक अभियोजक को निदेश दे सकती है।

(4) उपधारा (1) या उपधारा (2) के अधीन कोई अपील तब तक ग्रहण नहीं की जाएगी जब तक उच्च न्यायालय की इजाजत न हो।

(5) जहां दोषमुक्ति का ऐसा आदेश किसी परिवाद पर संस्थित मामले में पारित किया जाता है, और परिवादी उस आदेश के विरुद्ध अपील प्रस्तुत करना चाहता है, वहां परिवादी अपील की विशेष इजाजत के लिए उच्च न्यायालय को आवेदन कर सकता है, और ऐसा आवेदन, दोषमुक्ति के उस आदेश की तारीख से संगणित, जहां परिवादी लोक सेवक है, छह मास के भीतर, और अन्य प्रत्येक मामले में साठ दिन के भीतर, किया जाएगा।

(6) यदि, किसी मामले में, दोषमुक्ति के आदेश से अपील की विशेष इजाजत अनुदत्त किए जाने के लिए उपधारा (5) के अधीन कोई आवेदन नामंजूर कर दिया जाता है, तो उपधारा (1) या उपधारा (2) के अधीन दोषमुक्ति के उस आदेश से कोई अपील नहीं होगी।

Section 419 — Appeal in case of acquittal (English)

419. (1) The District Magistrate may direct the Public Prosecutor to present an appeal to the Court of Session from an order of acquittal passed by a Magistrate in respect of a cognizable and non-bailable offence.

(2) Where such an order of acquittal is passed in any case by any Court other than a High Court, the State Government may direct the Public Prosecutor to present an appeal to the High Court.

(3) Where such offence has been investigated by any agency empowered to investigate it under a Central Act, the Central Government may also, subject to the same conditions, direct the Public Prosecutor to present an appeal under sub-section (2).

(4) No appeal under sub-section (1) or sub-section (2) shall be entertained except with the leave of the High Court.

(5) Where such an order of acquittal is passed in any case instituted upon complaint, and the complainant desires to present an appeal against the order, the complainant may apply to the High Court for special leave to appeal, and such application shall be made within six months, where the complainant is a public servant, and within sixty days in every other case, computed from the date of that order of acquittal.

(6) If, in any case, an application under sub-section (5) for the grant of special leave to appeal from an order of acquittal is refused, no appeal from that order of acquittal shall lie under sub-section (1) or under sub-section (2).
