(1) जो कोई, किसी व्यक्ति को छलकर, उस छले गए व्यक्ति को कपटपूर्वक या बेईमानी से किसी व्यक्ति को कोई संपत्ति परिदान करने के लिए, या किसी व्यक्ति को कोई संपत्ति रखने देने की सहमति देने के लिए प्रेरित करता है, या छले गए व्यक्ति को जानबूझकर ऐसा कोई कार्य करने या करने से चूकने के लिए प्रेरित करता है जिसे वह न करता या न चूकता यदि वह इस प्रकार छला न गया होता, और ऐसा कार्य या लोप उस व्यक्ति के शरीर, मन, प्रतिष्ठा या संपत्ति को क्षति या हानि कारित करता है या करने की संभावना रखता है, वह छलता है, यह कहा जाता है।

स्पष्टीकरण—तथ्यों का बेईमानी से छिपाव इस धारा के अर्थ में छल है।

(2) जो कोई छलता है, वह ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि तीन वर्ष तक हो सकेगी, या जुर्माने से, या दोनों से, दंडित किया जाएगा।

(3) जो कोई, यह जानते हुए कि इससे उस व्यक्ति को सदोष हानि कारित होने की संभावना है, जिसके संव्यवहार में हित की, जिससे छल संबंधित है, रक्षा करने के लिए वह विधि द्वारा या विधिक संविदा द्वारा बाध्य था, छलता है, वह ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि पाँच वर्ष तक हो सकेगी, या जुर्माने से, या दोनों से, दंडित किया जाएगा।

(4) जो कोई छलता है और इस प्रकार बेईमानी से छले गए व्यक्ति को कोई संपत्ति किसी व्यक्ति को परिदान करने के लिए, या किसी मूल्यवान प्रतिभूति के संपूर्ण या किसी भाग को, या ऐसी किसी वस्तु को जो हस्ताक्षरित या मुद्रांकित हो और जो मूल्यवान प्रतिभूति में परिवर्तित की जा सकने योग्य हो, बनाने, परिवर्तित करने या नष्ट करने के लिए प्रेरित करता है, वह ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि सात वर्ष तक हो सकेगी, दंडित किया जाएगा, और वह जुर्माने का भी दायी होगा।

(1) Whoever, by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any property to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived to do or omit to do anything which he would not do or omit if he were not so deceived, and which act or omission causes or is likely to cause damage or harm to that person in body, mind, reputation or property, is said to cheat.

Explanation.-A dishonest concealment of facts is a deception within the meaning of this section.

(2) Whoever cheats shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.

(3) Whoever cheats with the knowledge that he is likely thereby to cause wrongful loss to a person whose interest in the transaction to which the cheating relates, he was bound, either by law, or by a legal contract, to protect, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.

(4) Whoever cheats and thereby dishonestly induces the person deceived to deliver any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
