सिक्कों, करेंसी नोटों, बैंक नोटों और सरकारी स्टाम्पों से संबंधित अपराधों के विषय में

जो कोई किसी सिक्के, राजस्व के प्रयोजन के लिए सरकार द्वारा जारी किए गए स्टाम्प, करेंसी-नोट या बैंक-नोट का कूटकरण करता है, या कूटकरण की प्रक्रिया के किसी भाग को जानबूझकर संपन्न करता है, वह आजीवन कारावास से, या ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि दस वर्ष तक हो सकेगी, दंडित किया जाएगा, और वह जुर्माने का भी दायी होगा।

स्पष्टीकरण (1)—"बैंक-नोट" से बैंकिंग का व्यवसाय करने वाले किसी व्यक्ति द्वारा जारी किया गया, माँग पर वाहक को धन के भुगतान का कोई वचनपत्र या वचनबंध अभिप्रेत है।

स्पष्टीकरण (2)—"सिक्का" से सिक्का अधिनियम, 2011 के संदर्भ में, वर्तमान में धन के रूप में प्रयुक्त तथा किसी राज्य या प्रभुसत्ता-संपन्न शक्ति के प्राधिकार के अंतर्गत मुद्रांकित एवं जारी की गई धातु अभिप्रेत है।

स्पष्टीकरण (3)—कोई व्यक्ति सरकारी स्टाम्प के कूटकरण का अपराध कारित करता है यदि वह किसी असली स्टाम्प को एक मूल्यवर्ग से भिन्न मूल्यवर्ग के असली स्टाम्प के समान प्रतीत होने वाला बनाकर कूटकरण करता है।

स्पष्टीकरण (4)—कोई व्यक्ति सिक्के के कूटकरण का अपराध कारित करता है यदि वह छल करने के आशय से, या यह जानते हुए कि इससे छल किए जाने की संभावना है, किसी असली सिक्के को किसी भिन्न सिक्के के समान प्रतीत होने वाला बनाता है।

स्पष्टीकरण (5)—सिक्के के कूटकरण के अपराध के अंतर्गत सिक्के के भार को घटाना, या उसके संघटन में परिवर्तन, या उसके स्वरूप में परिवर्तन भी सम्मिलित है।

CHAPTER 10

OF OFFENCES RELATING TO COIN, CURRENCY-NOTES, BANK-NOTES AND GOVERNMENT STAMPS

Whoever counterfeits, or knowingly performs any part of the process of counterfeiting, any coin, stamp issued by Government for the purpose of revenue, currency-note or bank-note, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.

Explanation (1).-"bank-note" means a promissory note or engagement for the payment of money to bearer on demand issued by any person carrying on the business of banking.

Explanation (2).-"coin" means, with reference to the Coinage Act, 2011, metal used for the time being as money and is stamped and issued by or under the authority of any State or Sovereign Power.

Explanation (3).-a person commits the offence of counterfeiting Government stamp who counterfeits by causing a genuine stamp of one denomination to appear like a genuine stamp of a different denomination.

Explanation (4).-a person commits the offence of counterfeiting coin who intending to practise deception, or knowing it to be likely that deception will thereby be practised, causes a genuine coin to appear like a different coin.

Explanation (5).-the offence of counterfeiting coin includes diminishing the weight or alteration of the composition, or alteration of the appearance of the coin.
