धारा 26 — विवादग्रस्त भूमि आदि के कब्जे में बने रहने का हकदार घोषित करने वाला मजिस्ट्रेट का आदेश

चूंकि यह मेरी संतुष्टि के लिए दर्शित हुआ है कि मेरी अधिकारिता के भीतर की ............... (भूमि, जल या उसकी सीमाओं) के संबंध में ऐसा विवाद विद्यमान है जो शांति भंग कारित करना संभाव्य है, और सभी पक्षकारों से उनके कब्जे के दावे के संबंध में लिखित कथन मांगे गए हैं;

जांच करने पर, और यह संतुष्ट होने पर कि कौन सा पक्षकार वास्तविक कब्जे में था, मैं एतद्द्वारा यह घोषित करता हूं कि वह (या वे) उक्त ............... के कब्जे में है (या हैं) और विधि के सम्यक् अनुक्रम द्वारा बेदखल किए जाने तक ऐसा कब्जा बनाए रखने का हकदार है (या हैं), और मैं एतद्द्वारा उसके (या उनके) कब्जे में किसी विघ्न को कठोरतापूर्वक निषिद्ध करता हूं।

(टिप्पणी: यह आदेश स्वामित्व के किसी विधिक अधिकार के गुणागुण का विनिश्चय नहीं करता, और केवल वास्तविक कब्जे के प्रश्न तक सीमित है।) यह प्ररूप 21-26 का बैच पूर्ण करता है।

Section 26 — Magistrate's Order Declaring Party Entitled to Retain Possession of Land, Etc., in Dispute (English)

WHEREAS it has been made to appear to my satisfaction that a dispute, likely to induce a breach of the peace, existed concerning................(land, water or the boundaries thereof) within my jurisdiction, and written statements have been called for from all parties concerning their claim to possession;

Upon inquiry, and being satisfied as to which party was in actual possession, I do hereby declare that he is (or they are) in possession of the said................and entitled to retain such possession until ousted by due course of law, and I do hereby strictly forbid any disturbance of his (or their) possession.

(Note: this order does not adjudicate upon the merits of any legal right of ownership, and is confined to the question of actual possession.)
