धारा 491 — बंधपत्र समपहृत होने पर प्रक्रिया

491. (1) जहां इस संहिता के अधीन कोई बंधपत्र किसी न्यायालय के समक्ष हाजिरी के लिए, या संपत्ति के प्रस्तुतीकरण के लिए है, और उस न्यायालय के, या ऐसे किसी न्यायालय के, जिसे मामला पश्चात् में अंतरित किया गया है, समाधानप्रद यह साबित हो जाता है कि बंधपत्र समपहृत हो गया है, या जहां, इस संहिता के अधीन किसी अन्य बंधपत्र के संबंध में, उस न्यायालय के, जिसके द्वारा बंधपत्र लिया गया था, या ऐसे किसी न्यायालय के, जिसे मामला पश्चात् में अंतरित किया गया है, या किसी प्रथम वर्ग के मजिस्ट्रेट के न्यायालय के, समाधानप्रद यह साबित हो जाता है कि बंधपत्र समपहृत हो गया है, वहां न्यायालय ऐसे प्रमाण के आधार अभिलिखित करेगा, और ऐसे बंधपत्र से आबद्ध किसी व्यक्ति से उसकी शास्ति के भुगतान की, या यह दर्शित करने की कि वह क्यों न दी जाए, मांग कर सकता है।

स्पष्टीकरण-किसी न्यायालय के समक्ष हाजिरी के लिए, या संपत्ति के प्रस्तुतीकरण के लिए बंधपत्र की किसी शर्त में, ऐसी किसी न्यायालय के समक्ष हाजिरी की, या, यथास्थिति, संपत्ति के प्रस्तुतीकरण की शर्त सम्मिलित समझी जाएगी जिसे मामला पश्चात् में अंतरित किया जा सकता है।

(2) यदि पर्याप्त कारण दर्शित नहीं किया जाता है और शास्ति का भुगतान नहीं किया जाता है, तो न्यायालय उसे इस संहिता के अधीन उसके द्वारा अधिरोपित जुर्माने के समान वसूल करने के लिए आगे बढ़ सकता है:

परंतु जहां ऐसी शास्ति का भुगतान नहीं किया जाता है और उसे पूर्वोक्त रीति से वसूल नहीं किया जा सकता है, वहां प्रतिभू के रूप में इस प्रकार आबद्ध व्यक्ति, वसूली का आदेश देने वाले न्यायालय के आदेश द्वारा, छह मास तक विस्तारणीय अवधि के लिए सिविल कारागार में कारावास का दायी होगा।

(3) न्यायालय, ऐसा करने के अपने कारण अभिलिखित करने के पश्चात्, उल्लिखित शास्ति के किसी भाग को परिहृत कर सकता है और केवल भाग में भुगतान प्रवर्तित करा सकता है।

(4) जहां बंधपत्र के प्रतिभू की मृत्यु बंधपत्र समपहृत होने के पूर्व हो जाती है, वहां उसकी संपदा बंधपत्र के संबंध में सब दायित्व से उन्मुक्त हो जाएगी।

(5) जहां धारा 401 के अधीन प्रतिभूति देने वाला कोई व्यक्ति ऐसा कोई अपराध करना साबित होता है जो यह दर्शाता है कि वह इस प्रकार जमानत पर छोड़े जाने के अयोग्य है, वहां वह न्यायालय, जिसने उसे इस प्रकार छोड़े जाने का आदेश दिया था, या कोई न्यायालय जिसे मामला पश्चात् में अंतरित किया गया है, लिखित रूप में अपने कारण अभिलिखित करने के पश्चात्, प्रतिभूति के संपूर्ण या किसी भाग को समपहृत कर सकता है, और तत्पश्चात् इस धारा के अधीन उस अपराध के लिए, जिसके लिए वह इस प्रकार छोड़ा गया था, उसके विरुद्ध कार्रवाई कर सकता है।

Section 491 — Procedure when bond has been forfeited (English)

491. (1) Where a bond under this Sanhita is for appearance, or for production of property, before a Court and it is proved to the satisfaction of that Court, or of any Court to which the case has subsequently been transferred, that the bond has been forfeited, or where, in respect of any other bond under this Sanhita, it is proved to the satisfaction of the Court by which the bond was taken, or of any Court to which the case has subsequently been transferred, or of the Court of any Magistrate of the first class, that the bond has been forfeited, the Court shall record the grounds of such proof, and may call upon any person bound by such bond to pay the penalty thereof or to show cause why it should not be paid.

Explanation.-A condition in a bond for appearance, or for production of property, before a Court shall be construed as including a condition for appearance, or as the case may be, for production of property, before any Court to which the case may subsequently be transferred.

(2) If sufficient cause is not shown and the penalty is not paid, the Court may proceed to recover the same as if such penalty were a fine imposed by it under this Sanhita:

Provided that where such penalty is not paid and cannot be recovered in the manner aforesaid, the person so bound as surety shall be liable, by order of the Court ordering the recovery, to imprisonment in civil jail for a term which may extend to six months.

(3) The Court may, after recording its reasons for doing so, remit any portion of the penalty mentioned and enforce payment in part only.

(4) Where a surety to a bond dies before the bond is forfeited, his estate shall be discharged from all liability in respect of the bond.

(5) Where any person who has furnished security under section 401 or 401 is proved to have committed any offence which shows that he is unfit to be so released on bail, the Court by which he was ordered to be so released, or any Court to which the case is subsequently transferred, may, after recording its reasons in writing, estreat the whole or any part of the security, and thereafter proceed against him under this section for the offence for which he was so released.
