धारा 447 — मामलों और अपीलों को अंतरित करने की उच्च न्यायालय की शक्ति

447. (1) जब कभी उच्च न्यायालय को यह प्रतीत होता है कि-

(क) उसके अधीनस्थ किसी दांडिक न्यायालय में निष्पक्ष और अपक्षपाती जांच या विचारण नहीं हो सकता है; या

(ख) असाधारण कठिनाई का कोई विधि-प्रश्न उत्पन्न होने की संभावना है; या

(ग) इस संहिता के किसी उपबंध द्वारा इस धारा के अधीन कोई आदेश अपेक्षित है, या वह पक्षकारों या साक्षियों की साधारण सुविधा की ओर उन्मुख होगा, या न्याय के उद्देश्यों के लिए समीचीन है,

तब वह यह आदेश दे सकता है-

(i) कि किसी अपराध की जांच या विचारण किसी ऐसे न्यायालय द्वारा किया जाए जो धारा 197 से धारा 205 (दोनों सम्मिलित) के अधीन अर्ह नहीं है, किंतु अन्यथा ऐसे अपराध की जांच या विचारण करने के लिए सक्षम है;

(ii) कि कोई विशेष मामला या अपील, या मामलों या अपीलों का कोई वर्ग, उसकी अधिकारिता के अधीनस्थ किसी दांडिक न्यायालय से समान या वरिष्ठ अधिकारिता के किसी अन्य दांडिक न्यायालय को अंतरित की जाए;

(iii) कि कोई विशेष मामला सेशन न्यायालय में विचारण के लिए सुपुर्द किया जाए; या

(iv) कि कोई विशेष मामला या अपील स्वयं उसके समक्ष विचारण या सुनवाई के लिए अंतरित की जाए।

(2) उच्च न्यायालय अधीनस्थ न्यायालय की रिपोर्ट पर, या किसी हितबद्ध पक्षकार के आवेदन पर, या अपने स्वयं के प्रवर्तन से कार्य कर सकता है:

परंतु उसी सत्र-खंड में एक दांडिक न्यायालय से दूसरे दांडिक न्यायालय को मामला अंतरित करने के लिए उच्च न्यायालय में कोई आवेदन तब तक नहीं होगा जब तक ऐसे अंतरण के लिए सेशन न्यायाधीश को आवेदन न किया गया हो और उसके द्वारा नामंजूर न किया गया हो।

(3) उपधारा (1) के अधीन आदेश के लिए प्रत्येक आवेदन प्रस्ताव द्वारा किया जाएगा, जो, सिवाय जब आवेदक राज्य का महाधिवक्ता हो, शपथपत्र या प्रतिज्ञान द्वारा समर्थित होगा।

(4) जब ऐसा आवेदन किसी अभियुक्त व्यक्ति द्वारा किया जाता है, तब उच्च न्यायालय यह निदेश दे सकता है कि वह इसकी सूचना लोक अभियोजक को दे, और उच्च न्यायालय, जब तक वह इस बात से समाधानी न हो कि आवेदन तुच्छ है, पक्षकारों को सुने जाने का अवसर दिए बिना उसे खारिज नहीं करेगा।

(5) जहां आवेदन किसी अधीनस्थ न्यायालय से मामले या अपील के अंतरण के लिए है, वहां अभियुक्त व्यक्ति, यदि उस न्यायालय ने विचारण या सुनवाई अभी प्रारंभ नहीं की है, न्यायालय को यह आदेश देने के लिए आवेदन कर सकता है कि उसके आवेदन के व्ययन तक, मामले या अपील में आगे की कार्यवाहियां रोक दी जाएं, और न्यायालय, जब तक उसे इसके विपरीत कोई कारण न दिखे, ऐसा आदेश दे सकता है।

(6) उच्च न्यायालय, इस धारा के अधीन कोई मामला अंतरित करते समय, अभियुक्त से यह अपेक्षा कर सकता है कि वह उस न्यायालय के समक्ष, जिसे उसका मामला अंतरित किया गया है, अपनी हाजिरी के लिए प्रतिभूति दे।

(7) उपधारा (1) के अधीन आदेश के लिए प्रत्येक आवेदन, जहां तक व्यवहार्य हो, तीस दिन की अवधि के भीतर व्ययित किया जाएगा।

(8) जहां इस धारा द्वारा प्रदत्त शक्तियों के प्रयोग के लिए कोई आवेदन खारिज किया जाता है, वहां उच्च न्यायालय, यदि उसकी यह राय है कि आवेदन तुच्छ या तंग करने वाला था, यह आदेश दे सकता है कि आवेदक, आवेदन का विरोध करने वाले किसी व्यक्ति को, प्रतिकर के रूप में, ऐसी राशि का भुगतान करे जो वह मामले की परिस्थितियों में उचित समझे।

(9) जब उच्च न्यायालय यह आदेश देता है कि कोई मामला किसी न्यायालय से स्वयं उसके समक्ष विचारण के लिए अंतरित किया जाए, तब वह ऐसे विचारण में वही प्रक्रिया अनुपालित करेगा जो उस न्यायालय द्वारा अनुपालित की जाती यदि मामला इस प्रकार अंतरित न किया गया होता।

(10) इस धारा की कोई बात धारा 218 के अधीन सरकार के किसी आदेश को प्रभावित करने वाली नहीं समझी जाएगी।

Section 447 — Power of High Court to Transfer Cases and Appeals (English)

447. (1) Whenever it is made to appear to the High Court-

(a) that a fair and impartial inquiry or trial cannot be had in any Criminal Court subordinate thereto; or

(b) that some question of law of unusual difficulty is likely to arise; or

(c) that an order under this section is required by any provision of this Sanhita, or will tend to the general convenience of the parties or witnesses, or is expedient for the ends of justice,

it may order-

(i) that any offence be inquired into or tried by any Court not qualified under sections 197 to 205 (both inclusive), but in other respects competent to inquire into or try such offence;

(ii) that any particular case or appeal, or class of cases or appeals, be transferred from a Criminal Court subordinate to its authority to any other such Criminal Court of equal or superior jurisdiction;

(iii) that any particular case be committed for trial to a Court of Session; or

(iv) that any particular case or appeal be transferred to and tried before itself.

(2) The High Court may act either on the report of the lower Court, or on the application of a party interested, or on its own initiative:

Provided that no application shall lie to the High Court for transferring a case from one Criminal Court to another Criminal Court in the same sessions division, unless an application for such transfer has been made to the Sessions Judge and rejected by him.

(3) Every application for an order under sub-section (1) shall be made by motion, which shall, except when the applicant is the Advocate-General of the State, be supported by affidavit or affirmation.

(4) When such application is made by an accused person, the High Court may direct that he give notice thereof to the Public Prosecutor and the High Court shall not, unless it is satisfied that the application is frivolous, dismiss it without giving the parties an opportunity of being heard.

(5) Where the application is for the transfer of a case or appeal from any subordinate Court, the accused person may, if that Court has not already commenced the trial or hearing, apply to the Court for an order that pending the disposal of his application, further proceedings in the case or appeal be stayed, and the Court may, unless it sees reason to the contrary, make such order.

(6) The High Court may, when transferring a case under this section, require the accused to furnish security for his appearance before the Court to which his case is transferred.

(7) Every application for an order under sub-section (1) shall, as far as practicable, be disposed of within a period of thirty days.

(8) Where any application for the exercise of the powers conferred by this section is dismissed, the High Court may, if it is of opinion that the application was frivolous or vexatious, order the applicant to pay by way of compensation to any person who has opposed the application such sum as it may consider appropriate in the circumstances of the case.

(9) When the High Court orders that a case be transferred from any Court for trial before itself, it shall observe in such trial the same procedure which that Court would have observed if the case had not been so transferred.

(10) Nothing in this section shall be deemed to affect any order of Government under section 218.
