धारा 443 — पुनरीक्षण मामले वापस लेने या अंतरित करने की उच्च न्यायालय की शक्ति

443. (1) जब एक ही विचारण में संयुक्त रूप से दोषसिद्ध किए गए कई व्यक्तियों द्वारा, या उनकी ओर से, पुनरीक्षण के लिए कोई आवेदन किया जाता है, और उनमें से एक या अधिक व्यक्ति उच्च न्यायालय को आवेदन करते हैं, जबकि अन्य सेशन न्यायाधीश को आवेदन करते हैं, तब उच्च न्यायालय, पक्षकारों की साधारण सुविधा और अंतर्वलित प्रश्नों के महत्व को ध्यान में रखते हुए, यह विनिश्चय करेगा कि दोनों न्यायालयों में से किसे पुनरीक्षण के आवेदनों का अंतिम व्ययन करना चाहिए।

(2) जब कभी पुनरीक्षण के लिए कोई आवेदन उच्च न्यायालय को अंतरित किया जाता है, तब वह न्यायालय उससे इस प्रकार निपटेगा मानो वह उसके समक्ष सम्यक् रूप से किया गया आवेदन हो।

(3) जब कभी पुनरीक्षण के लिए कोई आवेदन सेशन न्यायाधीश को अंतरित किया जाता है, तब वह न्यायाधीश उससे इस प्रकार निपटेगा मानो वह उसके समक्ष सम्यक् रूप से किया गया आवेदन हो।

(4) जहां सेशन न्यायाधीश ने उपधारा (3) के अधीन उसे अंतरित पुनरीक्षण के किसी आवेदन का व्ययन कर दिया है, वहां उच्च न्यायालय या किसी अन्य न्यायालय को पुनरीक्षण के लिए कोई आगे का आवेदन नहीं होगा।

Section 443 — Power of High Court to withdraw or transfer revision cases (English)

443. (1) When any application for revision is made by, or on behalf of, several persons jointly convicted at one trial, and one or more of such persons make application to the High Court, while the others make application to the Sessions Judge, the High Court shall decide, having regard to the general convenience of the parties and the importance of the questions involved, which of the two Courts should finally dispose of the applications for revision.

(2) Whenever any application for revision is transferred to the High Court, that Court shall deal with the same as if it were an application duly made before itself.

(3) Whenever any application for revision is transferred to the Sessions Judge, that Judge shall deal with the same as if it were an application duly made before himself.

(4) Where the Sessions Judge has disposed of any application for revision transferred to him under sub-section (3), no further application for revision shall lie to the High Court or to any other Court.
