धारा 377 — जहां निरुद्ध विकृतचित्त व्यक्ति को उन्मोचन के लिए स्वस्थ घोषित किया जाता है वहां प्रक्रिया

377. (1) जहां धारा 369 की उपधारा (2) या धारा 374 के अधीन कोई व्यक्ति निरुद्ध है, और कारागार महानिरीक्षक, या, किसी लोक मानसिक स्वास्थ्य प्रतिष्ठान में निरुद्ध व्यक्ति की दशा में, उसके भ्रमणकर्ता, यह प्रमाणित करते हैं कि, उनके निर्णय में, उसे स्वयं को या किसी अन्य व्यक्ति को क्षति पहुंचाने के खतरे के बिना छोड़ा जा सकता है, तो राज्य सरकार तत्पश्चात् उसके उन्मोचन का, या अभिरक्षा में निरोध का, या उपचार के लिए किसी लोक मानसिक स्वास्थ्य प्रतिष्ठान में अंतरण का आदेश दे सकती है, और यदि वह ठीक समझे, तो एक न्यायिक अधिकारी और दो चिकित्सा अधिकारियों से मिलकर एक आयोग नियुक्त कर सकती है।

(2) आयोग तत्पश्चात् व्यक्ति की मानसिक स्थिति की जांच करेगा और ऐसा साक्ष्य लेगा जो आवश्यक हो, और राज्य सरकार को रिपोर्ट करेगा, जो उसे छोड़े जाने का, या अभिरक्षा में निरुद्ध रखे जाने का, जैसा वह ठीक समझे, आदेश दे सकती है।

Section 377 — Procedure where person of unsound mind detained is declared fit to be released (English)

377. (1) Where any person is detained under sub-section (2) of section 369 or section 374, and the Inspector-General of Prisons, or, in the case of a person detained in a public mental health establishment, the visitors thereof, shall certify that, in his or their judgment, he may be released without danger of his doing injury to himself or to any other person, the State Government may thereupon order him to be released, or to be detained in custody, or to be transferred to a public mental health establishment for treatment, and if it thinks fit to do so, may appoint a Commission consisting of a Judicial officer and two medical officers.

(2) The Commission shall thereupon inquire into the state of mind of the person and shall take such evidence as may be necessary and shall report to the State Government, which may order him to be released or to be detained in custody, as it thinks fit.
