धारा 374 — विकृतचित्तता के आधार पर दोषमुक्त व्यक्ति का सुरक्षित अभिरक्षा में निरुद्ध किया जाना
374. (1) जब कभी निष्कर्ष यह कथन करता है कि अभियुक्त व्यक्ति ने अभिकथित कार्य किया, वहां मजिस्ट्रेट या न्यायालय, जिसके समक्ष विचारण किया गया है, यदि ऐसा कार्य, पाई गई असमर्थता के न होते हुए, अपराध गठित करता, तो ऐसे व्यक्ति को सुरक्षित अभिरक्षा में, ऐसे स्थान और रीति में, जो मजिस्ट्रेट या न्यायालय ठीक समझे, निरुद्ध किए जाने का, या ऐसे व्यक्ति के किसी नातेदार या मित्र को सुपुर्द किए जाने का आदेश देगा।
(2) मानसिक स्वास्थ्य प्रतिष्ठान में निरोध का आदेश मानसिक स्वास्थ्य देखभाल अधिनियम, 2017 के अधीन राज्य सरकार द्वारा बनाए गए ऐसे नियमों के अनुसार होगा।
(3) नातेदारों या मित्रों को सुपुर्दगी केवल उनके आवेदन पर, और ऐसी प्रतिभूति दिए जाने पर की जाएगी जो यह सुनिश्चित करे कि सुपुर्द किए गए व्यक्ति की उचित देखभाल की जाएगी और उसे स्वयं को या किसी अन्य व्यक्ति को क्षति पहुंचाने से रोका जाएगा, और यह कि वह ऐसे अधिकारी के निरीक्षण के लिए, और ऐसे समयों और स्थानों पर, जो राज्य सरकार निदेशित करे, पेश किया जाएगा।
(4) मजिस्ट्रेट या न्यायालय इस धारा के अधीन की गई कार्रवाई की रिपोर्ट राज्य सरकार को देगा।
Section 374 — Person acquitted on ground of unsoundness of mind to be detained in safe custody (English)
374. (1) Whenever the finding states that the accused person committed the act alleged, the Magistrate or Court before whom or which the trial has been held shall, if such act would but for the incapacity found have constituted an offence, order such person to be detained in safe custody in such place and manner as the Magistrate or Court thinks fit, or delivered to any relative or friend of such person.
(2) An order for detention in a mental health establishment shall be in accordance with such rules as the State Government may have made under the Mental Healthcare Act, 2017.
(3) Delivery to relatives or friends shall be made only on their application and on such security being given as will ensure that the person delivered shall be properly taken care of and prevented from doing injury to himself or to any other person, and that he shall be produced for the inspection of such officer, and at such times and places, as the State Government may direct.
(4) The Magistrate or Court shall report to the State Government the action taken under this section.
