1. जो भी कोई (स्त्री या पुरुष लिंग का उल्लेख नहीं)
2. किसी स्त्री का
3. लज्जा भंग करने के आशय(Intention) से
4. स्त्री पर हमला(IPC sec. 351) या अपराधिक बल(IPC sec. 350) प्रयोग करेगा

उसे सजा कम से कम (Minimum) एक वर्ष जिसे 5 वर्ष तक बढ़ाया जा सकता है, इसके साथ ही आर्थिक दंड भी दिया जा सकता है। यहां यह स्पष्ट होना चाहिए कि धारा 354 एक यौन अपराध नहीं है, बल्कि किसी स्त्री पर हमला या अपराधिक बल प्रयोग इस आशय से किया गया हो जिसमे किसी स्त्री की लज्जा भंग हो। उदाहरण स्वरूप किसी सार्वजनिक स्थल पर किसी स्त्री द्वारा किसी अन्य स्त्री का कपड़े फाड़ कर बेपर्दा कर देना उसकी लज्जा भंग करना ही तो है। इसे और आसानी से समझने के लिए धारा 354 के अंग्रेजी भाषा को देखा जा सकता है, जहां सर्वनाम (Pronoun) के रूप में HE शब्द का इस्तेमाल किया गया है। IPC की धारा 8 में लिंग को परिभाषित किया गया है के अनुसार, 8. लिंग – “ पुलिंग वाचक शब्द जहां प्रयोग किए गए हैं, वे हर व्यक्ति के बारे में लागू हैं, चाहे नर हो या नारी “ 8 – “Gender “– “The pronoun “he” and its derivatives are used of any person male or female ”.

354. Whoever assaults or uses criminal force to any woman, intending to outrage or knowing it to be likely that he will there by outrage her modesty¹, shall be punished with imprisonment of either description for a term which shall not be less than one year but which may extend to five years, and shall also be liable to fine.

इस प्रकार यहां स्पष्ट है कि धारा 354 में किसी प्रकार का लिंग भेद नहीं किया गया है। अतः यह धारा स्त्री पर भी उसी रूप में लागू होगा जिस रूप में पुरुष पर।
