104. ऐसे अधिकार का विस्तार मृत्यु से भिन्न कोई अपहानि कारित करने तक का कब होता है – 

यदि वह अपराध, जिसके किए जाने या जिसके किए जाने के प्रयत्न से प्राइवेट प्रतिरक्षा के अधिकार के प्रयोग का अवसर आता है, ऐसी चोरी, रिष्टि या आपराधिक अतिचार है, जो पूर्वगामी अंतिम धारा में प्रगणित भांतियों में से किसी भांति का न हो, तो उस अधिकार का विस्तार स्वेच्छया मृत्यु कारित करने तक का नहीं होता, किन्तु उसका विस्तार धारा 99 में वर्णित निर्बधनों के अध्यधीन दोषकर्ता की मृत्यु से भिन्न कोई अपहानि स्वेच्छया कारित करने तक का होता है।

104. When such right extends to causing any harm other than death -

If the offence, the committing of which, or the attempting to commit which, occasions the exercise of the right of private defence, be theft, mischief, or criminal trespass, not of any of the description, enumerated in the last preceding section, that right does not extend to the voluntary causing of death, but does extend, subject to the restrictions mentioned in section 99, to the voluntary causing to the wrong-doer of any harm other than death.
