जो कोई, लोक सेवक होते हुए, ऐसे लोक सेवक के रूप में किसी अपराध के लिए न्यायालय के दंडादेशाधीन, या विधिपूर्वक अभिरक्षा में सुपुर्द, किसी व्यक्ति को गिरफ्तार करने या परिरोध में रखने के लिए विधितः बाध्य होते हुए, जानबूझकर ऐसे व्यक्ति को गिरफ्तार करने से चूकता है, या जानबूझकर ऐसे व्यक्ति को भाग जाने देता है, या जानबूझकर ऐसे व्यक्ति को ऐसे परिरोध से भागने या भागने का प्रयत्न करने में सहायता करता है,—

(क) यदि वह व्यक्ति मृत्युदंडादेशाधीन हो, आजीवन कारावास से, या ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि चौदह वर्ष तक हो सकेगी, जुर्माने सहित या रहित, दंडित किया जाएगा;

(ख) यदि वह व्यक्ति आजीवन कारावास से या दस वर्ष या अधिक के कारावास से दंडादेशाधीन हो, ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि सात वर्ष तक हो सकेगी, जुर्माने सहित या रहित, दंडित किया जाएगा;

(ग) यदि वह व्यक्ति दस वर्ष तक न पहुँचने वाले कारावास से दंडादेशाधीन हो, या विधिपूर्वक अभिरक्षा में सुपुर्द किया गया हो, ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि तीन वर्ष तक हो सकेगी, या जुर्माने से, या दोनों से, दंडित किया जाएगा।

Whoever, being a public servant, legally bound as such public servant to apprehend or to keep in confinement any person under sentence of a Court for any offence or lawfully committed to custody, intentionally omits to apprehend such person, or intentionally suffers such person to escape or intentionally aids such person in escaping or attempting to escape from such confinement, shall be punished,-

(a) with imprisonment for life or with imprisonment of either description for a term which may extend to fourteen years, with or without fine, if the person is under sentence of death;

(b) with imprisonment of either description for a term which may extend to seven years, with or without fine, if the person is under sentence of imprisonment for life or imprisonment for a term of ten years, or upwards;

(c) with imprisonment of either description for a term which may extend to three years, or with fine, or with both, if the person is under sentence of imprisonment not extending to ten years, or is lawfully committed to custody.
