जो कोई, किसी लोक सेवक को, ऐसे लोक सेवक के रूप में, किसी विषय पर जानकारी देने के लिए विधितः बाध्य होते हुए, उस विषय पर ऐसी जानकारी को सत्य के रूप में देता है जिसे वह मिथ्या जानता है या विश्वास करने का कारण रखता है,—

(क) साधारण कारावास से, जिसकी अवधि छह माह तक हो सकेगी, या जुर्माने से, जो पाँच हज़ार रुपये तक हो सकेगा, या दोनों से, दंडित किया जाएगा;

(ख) जहाँ दी गई जानकारी किसी अपराध के कारित होने से संबंधित हो, ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि दो वर्ष तक हो सकेगी, या जुर्माने से, या दोनों से, दंडित किया जाएगा।

स्पष्टीकरण—धारा 211 में तथा इस धारा में "अपराध" शब्द के अंतर्गत भारत से बाहर किसी स्थान पर कारित ऐसा कोई कार्य भी आता है, जो, यदि भारत में कारित किया गया होता, तो निम्नलिखित धाराओं में से किसी के अंतर्गत दंडनीय होता, अर्थात्, 103, 105, 307, धारा 309 की उपधारा (2), (3) और (4), धारा 310 की उपधारा (2), (3), (4) और (5), 311, 312, धारा 326 के खंड (च) और (छ), धारा 331 की उपधारा (4), (6), (7) और (8), धारा 332 के खंड (क) और (ख); और "अपराधी" शब्द के अंतर्गत ऐसा कोई व्यक्ति भी आता है जिसके बारे में यह अभिकथित हो कि वह ऐसे किसी कार्य का दोषी है।

Whoever, being legally bound to furnish information on any subject to any public servant, as such, furnishes, as true, information on the subject which he knows or has reason to believe to be false,-

(a) shall be punished with simple imprisonment for a term which may extend to six months, or with fine which may extend to five thousand rupees, or with both;

(b) where the information given relates to the commission of an offence, with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

Explanation.-In section 211 and in this section the word "offence" include any act committed at any place out of India, which, if committed in India, would be punishable under any of the following sections, namely, 103, 105, 307, sub-sections (2), (3) and (4) of section 309, sub-sections (2), (3), (4) and (5) of section 310, 311, 312, clauses (f) and (g) of section 326, sub-sections (4), (6), (7) and (8) of section 331, clauses (a) and (b) of section 332 and the word "offender" includes any person who is alleged to have been guilty of any such act.
