(1) जो कोई स्वेच्छया उपहति कारित करता है, यदि वह उपहति जो वह कारित करने का आशय रखता है या जिसे वह जानता है कि उससे कारित होने की संभावना है, घोर उपहति है, और यदि वह उपहति जो वह कारित करता है, घोर उपहति है, तो वह "स्वेच्छया घोर उपहति कारित करता है", यह कहा जाता है।

(2) जो कोई स्वेच्छया घोर उपहति कारित करता है, वह ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि सात वर्ष तक हो सकेगी, दंडित किया जाएगा, और वह जुर्माने का भी दायी होगा।

(3) यदि उपधारा (2) में निर्दिष्ट अपराध से भोगी को स्थायी निःशक्तता या स्थायी प्रसुप्त अवस्था (persistent vegetative state) कारित हो, तो अपराधी कठोर कारावास से, जिसकी अवधि दस वर्ष से कम नहीं होगी किन्तु जो आजीवन कारावास तक हो सकेगी, दंडित किया जाएगा।

(4) जब पाँच या अधिक व्यक्तियों का समूह, संयुक्त रूप से कार्य करते हुए, किसी व्यक्ति को उसकी जाति या समुदाय, लिंग, जन्मस्थान, भाषा, व्यक्तिगत विश्वास या किसी अन्य ऐसे ही आधार पर घोर उपहति कारित करता है, तो ऐसे समूह का प्रत्येक सदस्य घोर उपहति कारित करने के अपराध का दोषी होगा, और उसे ऐसे किसी भी भाँति के कारावास से, जिसकी अवधि सात वर्ष तक हो सकेगी, दंडित किया जाएगा, और वह जुर्माने का भी दायी होगा।

(1) Whoever voluntarily causes hurt, if the hurt which he intends to cause or knows himself to be likely to cause is grievous hurt, and if the hurt which he causes is grievous hurt, is said "voluntarily to cause grievous hurt".

(2) Whoever voluntarily causes grievous hurt shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

(3) Where the offence referred to in sub-section (2) causes permanent disability or persistent vegetative state of the victim, the offender shall be punished with rigorous imprisonment for a term which shall not be less than ten years but which may extend to imprisonment for life.

(4) When a group of five or more persons acting in concert, causes grievous hurt to a person on the ground of his race, caste or community, sex, place of birth, language, personal belief or any other similar ground, each member of such group shall be guilty of the offence of causing grievous hurt, and shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
