धारा 507 — वे अनियमितताएं जो कार्यवाहियों को दूषित करती हैं

507. यदि विधि द्वारा इस निमित्त सशक्त न किया गया कोई मजिस्ट्रेट, निम्नलिखित में से किसी बात को करता है, अर्थात्-

(क) धारा 85 के अधीन संपत्ति की कुर्की और विक्रय करता है;

(ख) डाक प्राधिकारी की अभिरक्षा में किसी दस्तावेज, पार्सल या अन्य वस्तु के लिए तलाशी-वारंट जारी करता है;

(ग) शांति बनाए रखने के लिए प्रतिभूति की मांग करता है;

(घ) सदाचार के लिए प्रतिभूति की मांग करता है;

(ङ) सदाचारी बने रहने के लिए विधिपूर्वक आबद्ध किसी व्यक्ति को उन्मुक्त करता है;

(च) शांति बनाए रखने का बंधपत्र रद्द करता है;

(छ) भरणपोषण के लिए आदेश देता है;

(ज) धारा 152 के अधीन स्थानीय न्यूसेंस के बारे में आदेश देता है;

(झ) धारा 162 के अधीन, लोक न्यूसेंस की पुनरावृत्ति या निरंतरता को प्रतिषिद्ध करता है;

(ञ) अध्याय 11 के भाग ग या भाग घ के अधीन कोई आदेश देता है;

(ट) धारा 210 की उपधारा (1) के खंड (ग) के अधीन किसी अपराध का संज्ञान लेता है;

(ठ) किसी अपराधी का विचारण करता है;

(ड) किसी अपराधी का संक्षेपतः विचारण करता है;

(ढ) धारा 364 के अधीन, किसी अन्य मजिस्ट्रेट द्वारा अभिलिखित कार्यवाहियों पर दंडादेश पारित करता है;

(ण) किसी अपील का विनिश्चय करता है;

(त) धारा 438 के अधीन कार्यवाहियां मंगवाता है; या

(थ) धारा 491 के अधीन पारित किसी आदेश का पुनरीक्षण करता है,

तो उसकी कार्यवाहियां शून्य होंगी।

Section 507 — Irregularities which vitiate proceedings (English)

507. If any Magistrate, not being empowered by law in this behalf, does any of the following things, namely:-

(a) attaches and sells property under section 85;

(b) issues a search-warrant for a document, parcel or other thing in the custody of a postal authority;

(c) demands security to keep the peace;

(d) demands security for good behaviour;

(e) discharges a person lawfully bound to be of good behaviour;

(f) cancels a bond to keep the peace;

(g) makes an order for maintenance;

(h) makes an order under section 152 as to a local nuisance;

(i) prohibits, under section 162, the repetition or continuance of a public nuisance;

(j) makes an order under Part C or Part D of Chapter XI;

(k) takes cognizance of an offence under clause (c) of sub-section (1) of section 210;

(l) tries an offender;

(m) tries an offender summarily;

(n) passes a sentence, under section 364, on proceedings recorded by another Magistrate;

(o) decides an appeal;

(p) calls, under section 438, for proceedings; or

(q) revises an order passed under section 491,

his proceedings shall be void.
